Man blows 0.00 on breathalyzer, gets arrested for DWI

    You can be cited for driving while impaired for any mental impairment including being sleepy. Drivers who fall asleep at the wheel account for over 1,500 deaths a year.

    This is true. Even if you had a drink, it is smarter to say you had none. You do not have to incriminate yourself.

    I got a ticket for jaywalking on 6th street on the night before Thanksgiving when there were literally no cars around. The worst thing about it is that you have to go to court for jaywalking tickets. I got lectured by some dip**** judge. It was great.

    Dude did run a stop sign. I'd like to see the dash cam video of his driving.

    Guy didn't deserve to be arrested or jailed for DWI. It was probably an excuse to get him off the road for unsafe driving.

    Those of you who lie about drinking, aren't the penalties worse if the blood level or breathalyzer shows you have? Best to be straight and stick with the truth from the beginning. We pay taxes to create a society for a reason.

    Just a few facts...

    There are 3 field sobriety tests that police officers in Texas can use, and the "eye test" that checks for nystagmus is the most reliable of the 3. If someone suspected of DWI passes this one, (which should be conducted first) well in my opinion, there is no need to conduct the two less reliable tests. I can guarantee the man who blew 0.00 passed the eye test.

    The results on a portable breathe analyzer that police officers carry in their vehicles are not admissible in court, it is used as a tool only to help the officers. Only the results from the one at the police station are admissible.

    If you've been drinking and get pulled over...

    1) roll down your windows to help release the aroma-- alcohol is easy to smell and it's on your breathe (obviously), breathing in your vehicle with the windows up exacerbates the smell.

    2) never take any tests-- police are only trying to gather evidence, many of those tests are difficult even when sober

    3) breathalyzer-- never take it... just more evidence... evidence that can't be backtracked or proven inaccurate. Not sure about the validity, but I heard putting a penny under your tongue helps blow legit.

    Well, damn. If caught doing 145, I wouldn't be surprised if an officer said, "put your hands up" before stepping to the window.

    Isn't there a speed threshold where you automatically go to jail?

    They busted a "gathering of teenagers" at a wooded hangout. Now while there was drinking going on, they hauled people away by blowing into a hat and smelling it. Lol...seriously? And what cops don't have a breathalyzer? Even I have a breathalyzer.

    I used to think like that. Then I lost more friends and then I had to watch the woman I love put Christmas decorations on the tombstones of her parents. These days I see someone drinking and driving I want to slide an icepick in their ****ing ear.

    You're joking, but he could have been on lean. At 2:50 he clearly has trouble standing up.

    That the dumbest thing I've ever heard and not truthful. I am intoxilyzer certified (I administer the tests and went to a 40 hour class to get certified).



    I am not going to sit here and defend an officer who doesn't know when someone is a DWI, but I have a real life story that I can relate to. I'd also like to see the video to see what probable cause was there for an arrest. Like I said, at 2:50 he has trouble standing up on one leg. In my extensive experience on the streets, someone who isn't impaired can stand on one leg. Don't be confused, there's a lot more than goes into a DWI investigation that just the tests alone. Everything observed leading up to it is also important. As well as other things observed throughout the contact with the officer.

    Real life story: Wound up arresting a guy that had wrecked in the bucees parking lot little over a year ago. Witnesses said he had been doing donuts so fast they thought he was going to flip. He couldn't explain to me why he was doing donuts in the parking lot. He wasn't a real young fella either. He really didn't know what was going on.

    He says to me, "I know I've had too much to drink", "I've been drinking all day" and "I knew I shouldn't have been driving." He said his brother in law was pouring him "something" all after noon. He was obviously intoxicated. It was apparent from his thick speech, terrible balance and lethargic movements. The guy was toasted.

    He exhibits 17 out of 18 clues in the sobriety tests (most good ones are 12-14). Also note, the SFSTs aren't pass or fail. It's a totality of the clues. He agrees to a breath specimen. It comes back .000. Didn't surprise me too much, as people these days are getting high on anything and everything, but he did say he had been drinking for a while, which did kind of surprise me. His blood also had "nothing" in it.

    Once we got back to the jail from the blood draw, his sobriety state had reclaimed him. It was obvious that whatever he was on left his system pretty quick.

    An investigator with the DA's office called me inquiring about anything I had found in the car or anything else I could recall. They were left scratching their heads. He couldn't believe that based on the video and admissions, the crime lab hadn't found anything in his blood.

    I would later find out that there's supposedly one crime lab in the US that tests for synthetic mar1juana, a real popular drug amongst black folk (I'll assume y'all didn't know that :p). Outside of alcohol, it's a toss up what a blood draw is going to yield. And there's LOTS of drugs out there that will impair you that no one really knows what they are. The drug chemist are ahead of the crime lab.

    I could easily have been one of these officers on the news, making clutchfans, with you guys talking about how I need to be in prison for an unlawful arrest, for a lawful arrest.

    In this case, there may in fact be more to the story. Seems strange this story would release without the full video. Watch 2:50 again.

    I'm not going to pretend there aren't officers who are over zealous and hope and pray their defendant is going to blow over .08 back at the jail. There shouldn't be any doubt as to when you have someone who has lost their "mental and physical faculties."
