    Can you provide the link where hit and run=FSRA and does not = FSGI. I would think both are hit and runs.

    Call HPD hit and run and ask for the definitions since I know you won't believe me. I worked in the pressroom at 61 Reisner Street for more years than I want to recount.

    In Texas, the crime is a third degree felony if the accident involves a fatality or serious bodily injury. Accidents causing less serious injuries are punishable by imprisonment in the Texas Department of Criminal Justice for not more than five years or confinement in the county jail for not more than one year and/or a fine not to exceed $5,000. Accidents causing $200 or more in total damages without injuries are punishable by a class B misdemeanor, and accidents causing less than $200 in total damages are a class C misdemeanor.[10]

    In the end its all semantics. If he really did what he was accused of doing then he hit a car and ran. So it was a hit and run.

    You do realize I can go to Wikipedia and change all that. Wiki is NOT a trusted source. If you don't believe that, call Wiki in a court of law to refute a police officer and see who wins. BTW, re-read your Wiki definitions -- one is a felony and the other is a misdemeanor.

    Here is the original statute that the wikipedia article cites:

    It includes the felony, class B and class C misdemeanors previously mentioned. No where is the term hit and run used. My point is that calling it or not calling it a hit and run doesn't make a difference because its not legal terminology...but really he hit a car and ran though.

    Bingo! There is no legal term "hit and run." They are FSRAs and FSGIs. One is a felony because it involves injury and the other is a misdemeanor because it involves property damage -- but no injury or injuries.

    Okay..originally you were trying to say one was a hit and run and the other was not. Where did you or HPD come up with that if a hit and run is not legally defined? Sorry, I'm not trying to beat a dead horse or be an ass, I'm just wondering.

    No, I never said that. The story cited by the OP called it a "hit and run." The offenses both are legally defined but not as "hit and runs." Often times -- and I'm not saying this what happened in the Berry case -- a driver leaves the scene of an accident because he or she is DUI or carrying illicit goods.
