Because over the course of the rest of her life, unless they find a real cure, she'll have to buy Herpes supressant drugs, which can really add up over the next 40 or more years. I think 15 grand was generous of the first jury. half a mil is focking obscenely recockulous.
Lime says he didnt know he had it....can you have Herpes and not know about it? I assume Lima was married at the time to the pretty blonde.....something tells me he wont be seeing the "brass ornaments" anytime soon
It is a classic case of a battery tort (can you tell I've been stdying for finals?) Having sex with someone and not telling them that you have a STD is considered an offensive or harmful (depending on whether you actually end up with the disease or not), unprivileged, contact. Magic Johnson got sued for this too. Girl he slept with ended up HIV negative and so she went the offensive road... Defendants have argued (often unsuccessfully) that consenting to unprotected sex is a consent to exposure to STD's that the other party might have, even if they don't mention it. So I guess what can be learned from this legally is that you should wrap it up, B!
What it says to me is don't sleep with someone with whom you are not familiar (esp. unprotected) unless you are prepared to pay the consequences. She doesn't deserve a red cent for her actions. It's a different story when a man rapes a woman and infects her with an STD, but this woman made an apparently conscious decision to behave as she did. No breathing American would support a law allowing the government to require individuals to disclose their entire medical and sexual histories before they get in bed together. Likewise, no one has a right to be paid damages if a personal decision made between individuals backfires. At some point, adults must begin to take responsibility for their own actions if they want to maintain any semblance of true freedom.
