I hate to say it, but in this case, the defendant has the advantage. Most criminals don't think they did anything wrong. Therefor they don't think they are lying. And therefor they can fool the machine. Kobe, if guilty, may honestly not think he raped her even if he did. So the machine can't pick that up. It's sad. But it's just like George Cosanza said. If you believe in the lie it's not a lie.
If lie detectors were reliable there'd be no point to a large portion of the legal system. mull that over for a while. I would imagine "human lie detectors" would be even less reliable.

Lie detectors can never be used as a source of evidence because of the margin of error. When you look at an individual case, an accuracy rating of, say, 85% seems pretty high. But then take that assumption, and make it a means of determining guilt or innocence, and that means 15 out of every hundred people convicted by virtue of that system are innocent. That would be reality...would you want that to be ennacted? And were you an innocent defendant, would you want to take that chance? So the assumption that only guilty people would refuse is seriously dangerous not to mention an inversion of the burden of proof.
There are also drugs that can force you to answer any questions. Give both of them a good doze, and ask factual questions, such as: did she ever say no? Unless one is 007 type, those drugs must be very effective.
