    Judge Rips Government For Lack Of Any Evidence In First Due Process Case Under Alien Enemies Act

    In the Abrego Garcia case, the United States Supreme Court held (5 to 4), in part, that anyone the Trump administration seeks to deport under the Alien Enemies Act as an alleged member of the MS-13 or the Tren de Aragua gangs is entitled to constitutional due process, including a federal court hearing brought by a habeas corpus petition.

    Now, we have had one of the first due process challenges brought to the Trump Administration’s invocation of the Alien Enemies Act, and it will surprise no one that a federal judge in Texas has excoriated the government for a complete lack of an evidentiary basis for the underlying charge that the two petitioners were members of Tren de Aragua. (The 37 page order and decision can be found here, and it merits a full read. The facts recited below are taken from the order and decision.)

    The case concerns a married couple, Julio Cesar Sanchez Puentes and Luddis Norella Sanchez Garcia, who came to the U.S. in 2022 from Venezuela and were eventually granted protection under the Temporary Protected Status (“TPS”) program for certain Venezuelan nationals. On April 1, 2025, Petitioners were notified by the Trump Administration that their TPA protected status had been withdrawn because they were associated with Tren de Aragua,” a “Foreign Terrorist Organization,” and they were subsequently arrested and imprisoned. Initially, the federal judge held that their imprisonment was illegal under the statute governing the TPS program.

    At the hearing, the charges based against Ms. Sanchez Garcia were principally based on her supposed “confession” to arresting officers that she was once married to a member of Tren de Argua, that she separated from him about ten years ago, and that her ex-husband was eventually killed by the Venezuelan government as a result of his gang membership. Plus, the government argued, it had secret “intelligence” evidence supporting her membership (which it would not share with the court). As to Mr. Sanchez Puentes, the government’s case — amazingly -- consisted of: “well, he chose to marry and have kids with Ms. Sanchez Garcia. So, he must be Tren de Aragua too.”

    The presiding federal judge David Briones was livid at the Trump Administration for the lack of any evidence to support the underlying charge of an association with Tren de Argua. As to Mr. Sanchez Puentes, Judge Briones wrote (pp. 32-33): “This Court takes clear offense to [the Government] wasting judicial resources to admit to the Court that it has no evidence.” And rejecting the “guilt by marriage association” theory, the Judge denied the Government an opportunity to even make a closing argument against Mr. Sanchez Puentes.

    As to Ms. Sanchez Garcia’s guilt by a deceased ex-husband, and undisclosed “secret evidence,” Judge Briones was similarly scathing (pp. 24-30).

    Hey look - JD Vance says nothing of substance.

    “Liberal Judges”… “gang members” …. The SCOTUS isn’t a group of liberal Judges… the point blank said to bring Garcia back. Vance and goons have openly defied the Supreme Courts order. Vance and Trump and the rest of the Authoritarian losers that have to pay for sex are wrong on this issue… bring Garcia back - jump through the hoops and if he is deported, he is deported.

    Don't want to get in the middle of you and Nook, but I would lean towards a third option - he doesn't care whether it's true or not. He only cares that it is the narriative that lets him do what he wants.

    I felt silly at first when I assumed that Trump didn't know the 'MS13' was a text overlay when he first tweeted it out. I was convinced by other people that 'Trump of course knew, he just wanted to be clear that those symbols stood for MS13'.

    Now I feel stupid for giving Trump the benefit of the doubt.

    Once again woke Dems make such a big deal about something so stupid, yes the tattoos are real and yes they are extremely suspicious because they do symbolize MS13..... As someone who knows a little about photoshop its insulting even to say it was "photoshopped" because it implies and misleads people into thinking the tattoos were also added since Arial font letters added on virtually any editing software like paint/word/adobe acrobat can now be considered photoshop.

    Was Trump and co also trying to mislead people by just editing the picture with just the letters of what each tattoo symbolizes instead of putting in bold text what each tattoo represents? Maybe... Is that right? No... Is it right to push this weak case against Trump for a very likely MS13 gang member? No way..... Those "photoshopped letters" are nothing to the media's "loving father" "citizen" "mistakenly deported" "he was married" bs narrative.....

    He wasn't a loving father and husband when he beat his wife, he also wasn't a good citizen when two immigrations courts found him to be an ex MS13.... We do hold Trump to the highest of standards but the media can say what ever the **** they want and its fine.....

    Kilmar is home, I'm sure Bukele is handling this man very carefully due to the media backlash. If truly innocent he should be set free in El Salvador, end of story....

    Out of so many things Democrats can focus on that really is important this is what they chose for over a month. This is why they lost the election, the inability to connect with people on issues that truly matter. If Kilmar was a rando picked up off the streets with no record, no association with gangs, no restraining orders, no deportation orders, no gang tattoos, no MS13 findings by immigration courts I'd say its a fair topic for a couple of weeks.... But they rode it despite being a weak case to begin with.

    Once again we are seeing that Dem's biggest priority is making Trump look bad and not making the country better.

    One thing I will say, all this bs has really shun light on how insignificant we are as normal citizens. We are just tiny little pieces on the chess board for the wealthy competing for power. Both Democrats and Republicans feeding us bs propaganda trying to out bs each other in order for us to think one is the good guy and the other bad guy when both are bad guys that needs our support to stay in power.....
