Really? That is ridiculous - and there is no such thing as a hate crime, a crime is a crime.

Let the guy do the time.....send him away for it....

    Hate crime - wtf ever.

If it had been an old white guy would it have been any better?

Why somebody commits a crime has never really mattered to me, this is scumbag behavior regardless of the racial factor.

Well, sucker punching old folks is pretty much frowned upon universally, even if it's a black man in Texas

Of course there are hate crimes. Are you going to deny that folks commit crimes against another race or sexual orientation simply because that person is of another race or sexual orientation?

Gays get beat up simply because they are gay. Blacks get beat up simply because they are black. Whites get beat up simply because they are white. Granted "a crime is a crime", but when the sole reason for the crime is the person's race, religion, sexual orientation, etc. then the "hate" crime law can take affect.

Sometimes I wish everyone did have guns, so that this moron can get gunned down before he even gets trial.

Then I realize this isn't Florida.

Dafuq? umm yes there is...and it is written in law. What kind of logic is this? If this dude was "hunting" down an African-American to do this to, then this is a crime of hate (I saw the TV news report and this is the exact word that was used.) This is like ignoring racism.

Curious as to why a majority of the other "Knockout Game" footage seen online has been black person hitting a white person and it's not considered a hate crime.

**edit: missed the part where he wanted to hit a black guy to see if it would get coverage.

    http://www.houstonchronicle.com/new...s-emerge-of-knockout-game-suspect-5097416.php

Two images emerged Friday of a 27-year-old Katy man charged with a brutal hate crime that he allegedly committed as part of a so-called "knockout game."

Conrad Alvin Barrett's defenders call him a troubled young husband with a history of alcohol and substance abuse, saying he was committed in 2010 with a bipolar disorder but has held down a job with medication and support from his parents.

At a hearing in federal court Friday, however, prosecutors described Barrett as a vicious predator who filmed himself "hunting" for African-Americans for at least a week before targeting an unsuspecting 79-year-old black man to punch out in the knockout game.

"There's a very sinister chuckle," FBI agent Al Tribble said of cellphone video that Barrett filmed as he approached his victim.

After Barrett broke the elderly man's jaw in three places, Tribble testified, "He exclaims in jubilation, 'Knockout, baby!'‚ÄČ"

    ...

Prosecutors describe it as a hate crime because, they say, Barrett allegedly targeted black people as victims in an attempt to gain notoriety.

After hearing about Barrett's two sides, U.S. Magistrate Judge Frances Stacy ruled that he will stay in federal detention. Barrett was arrested after a warrant was issued earlier this week.

"He stalked his victim," Stacy said. "It's a hate crime. It's a crime of violence. The victim, an old man, lost three teeth."

The judge assured Barrett's attorney and parents that he will be given his medication while awaiting trial behind bars, accused of a hate crime punishable by 10 years in federal prison.

    Father pleads in vain

Barrett, dressed in an orange jail uniform and wearing handcuffs and leg irons, did not speak at Friday's hearing but hung his head as his father testified about his son's alcohol abuse and psychological problems.

"He was in psychiatric lockdown at Methodist," Patrick Barrett said of his son. The elder Barrett tried in vain to convince the judge that his son would take his medication if released to him and his wife, a schoolteacher of 39 years.

The father's reassurances were met with hostility by prosecutors, who pointed out that Barrett had not taken his medication for at least three weeks before the alleged attack. Even more damning, prosecutors said, they believe Barrett told his father about the attack when it happened.

"He's going to do anything to cover up for his son," said Assistant U.S. Attorney Ruben Perez. "He'll say anything to keep his son out of jail."

Perez said the defendant used alcohol daily, smoked marijuana weekly and used cocaine at least once in the past month.

    Medical status noted

George Parnham, Barrett's attorney, argued that his client has been diagnosed with bipolar disorder and was off his medication when he "bizarrely" used his cellphone to record an apparently random attack, then bragged about it.

"This is a sad, if not tragic, set of circumstances," Parnham said. "But the last thing a person off their medication when they do something like this is going to do is try it again."

He said people with psychological problems do not like to take their medication because they do not want to admit something is wrong. But, he unsuccessfully argued, strict oversight from the court can overcome that reticence.

    Victim not identified

A day before the hearing, the charges against Barrett were unsealed detailing the allegations, including that he laughed after hitting the victim, who has not been named.

Barrett was found out after he showed the video to random strangers in a Fulshear restaurant after the attack, one of whom was an off-duty arson investigator.

After seeing the video, the investigator notified authorities, who then confiscated the phone.
