See my first post in this thread. Whether this occurred at a school function is at the crux of this case. If it happened after school and off school grounds I don't think there would be much dispute that the school had no standing in regulating student speech.
Then he's advocating underage drinking, which would fall under the same rule. "Stem Cells 4 Jesus", however, may have been really interesting. I'm pretty sure that one ends with a "go directly to Gitmo, do not invoke habeas corpus" card.
If you are going to overturn free speech, they it better be for a clear and unmistakeable reason....like yelling fire in a theatre is going to cause harm to people. But this doesn't come near that. The school has failed to make a convincing case and no restriction should come out of this.
