Just squeaked by field sobriety test...whew !

    You are one luck SOB...Shouldn't have been driving...I admit, I still drive after a couple, but I stop an hour or so before I drive...Of course, if I was completely hammered, taxi for me...Of course, with my big arse, it takes a lot to get me tipsy...

    I wouldn't have even got into the car

    if im not sure whether i can drve than theres no way im getting into a car.

    all those don't drink and drive commercials scare the hell out of me. i dont want anyones blood on my hands

    I think you guys are rushing to judgement here, I stopped drinking more than 2 hours before I drove.

    Now I consumed ONE drink an hour for the previous 7 hours, along with food and water.

    Again, I say, I was not drunk, but you can never be sure as I think the legal limit of .08 is too low and some people can handle more than that....

    Not saying I am one of them, but still.

    And, I am happy that the cop agreed with me and let me go......that should say a lot.

    And I was relieved that I would not be tied up defending my sobriety in court and have my license pulled for refusing a breathalizer (which I would NEVER take).

    I just glad you didn't kill anyone that night.

    Imagine your bad luck. You get let off by the cop, but then kill someone on the road 2 min later. :(

    Drunk driving sucks. I try to have a driver when we're all out...but sadly it doesn't always happen.

    What, in Texas one is given the options of either taking breathalyzer or a sobriety test, when you are pulled by a cop on suspicion of DUI?

    No. You are asked to take a sobriety test if they are suspicious. A breathalyzer is the next step if they think it's warranted. You can refuse to take it, which can be a freakin' pain, so I've heard, but I certainly would refuse one if asked, were I in DD's situation. A good attorney may get you off, but not if you flunk a "scientific instrument." Personally, I don't have much faith in them. Scientific instruments can be defective. The person operating it can screw up. If there is a false reading, you're are out of luck. My skepticism is partly based on a lie detector test I took in 1970. I lied about a couple of things of a personal nature (I was a hippie... draw your own conclusions) and passed with flying colors, getting the job.

    I'm a skeptic as well as a cynic. ;)

    That makes sense IMO. The reason I asked is that I was wondering what if you had just washed your mouth with Listerine and was forced to breathe into a breathalyzer on the order of a cop who pulled you over. There is some serious alcohol content in Listerine mouthwash and you could be very likely to fail the breathing test.

    Being "drunk" isn't the standard. It's simply intoxicated, i.e."impaired".

    In other words, were you anything but normal that night when you were pulled over?

    The bottom line is there's a method to the madness with DWI law. It's not just to jam us up legally and financially.

    Until they start making it mandatory to submit to BLOOD tests during the course of a DWI investigation, we're either going to b**** about the supposed fallacies of the Intoxilyzer or that those "damn cops" are just screwing with our good time, etc...

    I find it amazing at the amount of acrimony and contempt toward police officers on this board by some posters.

    There's a certain myopia and narrowmindedness that perpetuates this idea that most cops are cops for the wrong reasons, and that their sole mission in life is to make our lives as uncomfortable as possible by -- heaven forbid -- enforcing the laws... whether it be speeding, DWI, suspended licenses, whatever.

    The bottom line is we're a country of laws. So instead of getting all 'touchy-feely' and blaming everyone else like we're in middle school and a hall monitor just caught us in the bathroom after the bell rings, we need to take responsibility for what we do and deal with the consequences.

    Otherwise, write your state representative and senator and explain to them why we need to have the law changed at the next legislative session.

    But my guess is that most of us won't do that. Because we're 'reactionary' and there seems to be a certain cachet about talking about certain subsects and occupations -- such as police officers.

    it all depends on the volume and % content of what you are drinking, but in general, most men can easily metabolize 1 drink an hour

    so if you had 1 1/2 in 2 hours, unless you are drinking shots of straight everyclear, you should be perfectly clean

    I've only read the formula, its neat seeing an actual calculator.

    If you run 6 beers in 6 hours for a 200lb guy, you can see the results would be way under the legal limit.

    You got so lucky that you were in Austin - 99.9% of the time people in Houston "fail" that test whether they were really impaired or not.

    Normally, I would call you an idiot for agreeing to the FS test, but I guess you were confident that you could pass it. Don't be - especially in Houston.

    And to answer ima's statement, yes Houston cops arrest people - oftentimes when they are not impaired at all - to up their DWI counts.

    Wanna know why? Overtime $$$.

    You know that the guys who make the most DWI arrests make well over $100k a year don't you? You think the cops are tripping over themselves to get on the DWI Task Force so that they can do the community some good?

    Look into overtime pay for HPD guys - it's a racket.

    So was it a speed trap? I don't visit Austin often. They're illegal in California.

    I guess my point was that there's a huge unrealized benefit to getting a cab. At the very least you won't have to deal with passionate replies against dui.... Doing it often does promote a pattern of behavior where there will be circumstances that really test your limits. All it takes is one accident or arrest.

    Just saying things you already know, good sir.
