So what would have happened if the plain clothes officer had gotten there a little earlier and was standing on the lawn, if Joe Horn had shot him would that have just been collateral damage?
It actually concerns me that you, as a police officer, think this way. Did Joe Horn know anything about the 2 when he walked out of his house with a shotgun? No. All he did was ignore the warnings of the 911 operator to confront 2 guys that were robbing his neighbor's house...not his. Had he stayed inside, was he in any danger? The only danger he was in was because he put him self there. You are a police officer. Do you really like the idea of the precedence this might set? Do you really want untrained citizens going around shooting perceived threats? What the hell do we need you for then? Yeah, the guys were scum. This, however, isn't a country where that deserves death.
I wish more citizens would carry firearms and were more conscious of potential threats. We the people have a right to bear arms. We as citizens of the United States of America have the right to defend ourself and our property. Ok, you might not deserve to be killed for stealing something, or even burglarizing someone's house. But like I said earlier. What if those two clowns would have been caught for every piece of dope they've possessed, every home they've broke in to, and every other crime they have ever committed. I'm glad you clarified that and that you aren't recommending that people do what Joe Horn did. That said I think your abundant praise of Joe Horn is somewhat hypocritical given that you seem to recognize the recklessness of his actions.
He's lucky those guys weren't armed and shot him first. He's lucky he didn't shoot the off duty cop or someone else on accident. He's lucky his gun didn't jam and he get seriously injured by these two. He's lucky these were actually burglars and not a case of mistaken identity. I mean I once saw someone climb into a friend of mine's window in college. It turns out he was another friend from home. I have no doubt Joe Horn thought he was doing the right thing but this could've easily gone down very very badly. Taking the law into your own hands with guns just seems like a bad idea.

Bingo. Ourselves and our property. It wasn't his house. They weren't threatening him in his home. If he would have stayed inside, the 2 burglars would probably be in prison by now, where they deserved to be and Horn would still be in his home.
These guys were not a threat to him. They weren't robbing him. Did he have a right to shoot them? The verdict shows that he did. Whether you think that he did the right thing or not is completely irrelevant. What he did blurs the lines of what is okay. Basically, this is telling people that is okay to shoot criminals whether they are a threat to you or not. It sounds funny but one day somebodies going to gun down someone smoking pot in their yard and Joe Horn will be brought up. Its seems pretty clear that what he did was illegal, so he should be punished accordingly. When you start wondering whether he was right or not you are getting into a gray area which has no place in law.

The laws are lenient because the government believes people can be rehabilitated, they can. I have seen it first hand with many family members. At the end of the day there are no winners in this case, certainly not the two criminals who were shot, and certainly not Joe Horn who has to live with the fact that he took two guys lives. Just sad all the way around. DD
