It's actually not legal in theory in Texas. The law says different, and the application for the tags itself says: "If a vehicle is not being used to transport a disabled person, the vehicle may not [emphasis in the original] be parked in areas specially designated for disabled person parking."

The application even says that the disabled person should keep the original of the application to verify their disabled parking credentials. I assume that's for if they are challenged by the police or whoever.

i can't argue the legality, because, as others have stated, if the pass is valid, you're legally allowed to park wherever you please. but i think there's a real fine line between not being able to walk a great distance and not wanting to walk a great distance.

just remember, rocketten parker, with handicap parking power comes great responsibility....

So then, it is perfectly legal for Rocketteen to park in a handicapped parking space.

As for whether it was inconsiderate/unethical, consider:

    (1) What are the chances that 4 people in separate parties arrive later in the evening, all of whom are more disabled than Rocketteen.

    (2) How disabled does a disabled person have to be to ethically be allowed to use the spot? If chance of re-injury from parking far away were 90%, I'd say use of the handicapped parking is justified. What about a 50% chance? a 10 % chance? a 1% chance?

    (3) What role does a disabled person's bravado play in his claim on a parking spot? If he avoids handicapped parking spots in some situations because he doesn't think he needs it, does that disqualify him from ever using a handicapped parking spot? The doctor apparently did think he needed the spot. If he ignores a doctor's prescription and gets away with it, does that invalidate the advisability of the doctor's prescription?

I would think being an Ag is enough of a handicap. Couldn't get into UT?

Jeff, b/c of your back, was that the reason u went into massage therapy?

Originally, yes. I went to numerous doctors, all of whom said they couldn't help and even spoke to me about the possibility that I would remain permanently disabled.

I was NOT even slightly interested in or motivated by holistic medicine at the time. At the time, I thought it was kooky. (surprise!)

However, after less than 8 months, I was rehabilitated to the point that I was essentially back to normal. I still had to strengthen my back but the injuries were healed. That was very influential on me both from the standpoint of my interest in massage as well as my interest in alternate forms of medicine and therapy.

It sounds like if his disability ended he cannot legally use the permit regardless of the valid date on the permit.

I think both sides are wrong. From Rocketteen's description in his 1st post it sounds like he no longer is disabled. He should not continue to use the permit if this is the case. I would not have a "big problem" with the other guys initial question if it was like "Do you really need to use that space" but as others have said that is presumptions and maybe is better left unsaid unless you really know better. The other guys persistant questioning after Teen said he is authorized to use the space or the like was way out of bounds. But this whole thing could have been resolved much easier and without all this discussion if both parties were well armed. Why complicate matters with legality, let alone ethics. Another reason to support one Western politician's proposal that persons who will not carry conceiled handguns must pay a tax because of the lengthy desputes they may cause.

putting my opinion down because my age doesnt bother me because i doubt that you're that much older than me.

ANYWAY let me break it down for you AGAIN since people get crancky about the use of the word DICK.

legally it is okay, but morally it is not...

by moving your car you were either afraid of the guy who was giving you a hard time or you thought you were breaking the law. im sure your morals played NO PART in it.

we are obviously different kinds of people. i live my life (as much as i can) by what i think is morally right, and you park in handicapt spaces that you dont need.

i have no more comments on this pitty party.
