NBA players involved in lawsuit vs. NBA in California's Northern District file notice of voluntary dismissal of complaint without prejudice.

    Something is going on here.

Why would the players agree to dismiss the charges?

    They are up to something.

Was told move for voluntary dismissal is procedural rather than substantive which means players/attorneys may just refile.

    usat_jzillgitt Jeff Zillgitt
Pulling it out, but very possible they refile. RT @GreedyNBAstards: @usat_jzillgitt Does that mean they are pulling the suit out of court?

    usat_jzillgitt Jeff Zillgitt
Voluntarily dismissing the case allows players/attorneys to refile without asking for permission from the court.

    usat_jzillgitt Jeff Zillgitt
Not clear yet on reasons for dismissal, but will learn at 6 p.m. news conference; could just be changes to the complaint and will refile.

It means that they don't want the California case heard at this time, but they are keeping the door open to refile if necessary. It's difficult to speculate to their intent prior to the press conference. It could just mean that they've decided to consolidate the litigation in either New York or Minnesota, or it could symbolize a breakthrough in negotiations.

Thanks, we'll find out soon enough.

I'm holding out hope that the reason they don't wan this case heard at this time is so they can get back to the negotiation table.

looks like a solid prediction you made.

At law firm repping players. There is a fancy firm cocktail event 20 feet away. Will they notice if I snag one glass of wine?

David Boies says players filing consolidated complaint, combining the cases in Calif. and Minnesota.

    KBergCBS Ken Berger
"This should permit us to expedite the case," Boies said of the consolidated complaint.

    LarryCoon Larry Coon
This is a good move for the sake of expediency. No hearings to determine whether to consolidate; fewer venue issues.

    KBergCBS Ken Berger
There will be some additional plaintiffs who "wanted to join," Boies said.

    KBergCBS Ken Berger
"This is now a consolidated class action on behalf of all the players," Boies said. "If we had not done this, the courts would've done it."

    KBergCBS Ken Berger
New players listed as plaintiffs include Steve Nash and Baron Davis.

    HowardBeckNYT Howard Beck
Lawyers for NBPA lawsuit have announced merger with separate suit in Minnesota. One case going forward to expedite process.

    KBergCBS Ken Berger
Rajon Rondo, Sebastian Telfair aand Anthony Randolph also are added to the list of plaintiffs.

Boies says there have been no discussions between the players and the NBA, no efforts for a settlement or negotiations.

    KBergCBS Ken Berger
Boies called league's statement "ridiculous. Weren't the ones that filed suit prematurely 3-4 months ago before there was a controversy."

Boies says no settlement talks have taken place to this point. "It takes two people to negotiate," he said.

    KBergCBS Ken Berger
Boies said if he felt league legal reps would be receptive, he'd have "no problem calling them." Reiterates that case should be settled

There is absolutely no reason to be optimistic the #NBAlockout is headed for a resolution anytime soon

    sheridanhoops Chris Sheridan
In other words, Boies seems to be saying he hasn't called NBA because he feels disrespected by NBA's reactions to anti-trust filing.

Let me sum up this conference from the NBA players lawyers: the two sides are still pointing fingers at one another. Going nowhere.

Whenever NB A hopes seem to hit rock bottom, they dig deeper. Sides can't shuffle paper without sniping, accusing. No calls. Lots of blame.

This who should call whom detailed breakdown may be low point of lockout.

    KBergCBS Ken Berger
Challenged on why he hasn't called NBA, Boies bristled and said NBA statement shows why it's a "waste of time" to make a phonecall.

Billy Hunter: "We're ready to sit down and get this thing resolved when it's so indicated."
