I'll have to try to find the link, but I believe the first paychecks were due on the 15th and since the union disbanded before that those paychecks will be included in the damages portion of their suits.

The problem is that the earliest players can receive retributions is after a trial, and if that happens it could be years at best before they see anything. What the union / trade association is banking on is for a judge to order the lock out illegal so that the players don't miss anymore checks, but even if that happens the NBA will appeal up to the supreme court just like the NFL did. The players better hope they have some savings or a second job.

I have no clue one way or the other. All I know is no one expected the players to give the owners the finger, assuming they couldn't go without $$. Yet, for whatever reason, they gave them the finger even though it will cost them $$. So.......

Last comment on it, since my last post was trying to provide a lockout update (that the first round of checks would be included in a potential settlement).

NBA Lawyers & Stern could offer a settlement at any time mind you. I guess we shall find out in the next week or two if they really did want to lose the season or if they were just bluffing. Thats the leverage that Hunter and the players have created. I cant say I blame them. The ball is in their court to make a deal happen.

Marc J. Spears of Yahoo! Sports reports that the players' antitrust lawsuit against the NBA is currently scheduled for Feb. 29, 2012, but could be moved up to an earlier date.
Optimists have to hope not only that the court date is moved up, but more importantly, hope that the case somehow gets settled before going to trial at all. Unfortunately, an initial court date of Feb. 29 isn't likely to force anyone to be in a huge hurry at the moment.

The owners offered the union a settlement and it was turned down. The game-play is over. The bluff will be called.

If you (or anyone else) thinks a "settlement" will be much different than what the players turned down, your introduction to reality is coming. The longer this goes, the worse for the players. 47% might turn into 43% if the season is missed.

If they dont settle they stand the chance of paying the players salaries for the lost year in damages and losing revenue from the season. Regardless of Sterns claims in that they would give a much worse offer(which would support the players claim of an ultimatum being used) if the players did not accept the offer, there is still a mighty risk for the owners to take. Lose revenue from the season and still pay the players if they were found guilty.

If the owners do not offer another settlement, it means that they think they will win in court and get the system that they want ultimately. Not saying they dont, but its a big risk for the NBA to take.

Im not saying the NBA wont win in court, which they probably would, but as long as there that large amount of risk involved, I wouldnt rule out completely a settlement from Stern.

FYI, the proposal offered on Thursday was not a court settlement. Its not a court settlement until one party is suing the other one. I think your confusing the proposal that the NBA offered as that.

Of course he's bluffing. The players dont really want to go to court in Feb. They want leverage. They gave complete responsibility of losing a season+ on the owners. Its the right move to make, just 4 months too late.

That's a very good point. If what you said is true, then I can definitely see a settlement reached soon. I doubt players really want a lawsuit either.

If the NBA owners wanted to truly make the players look bad they should tweak their last offer a bit and make it a bit more enticing in order to settle out of court. Stern could go on TV and put a spin on it telling everyone how he has made another offer and that he has done everything in his power to save the season and now it is up to the players whether they want to play a season or go to court. The public vote is already with the owners imagine if Stern pulled this. The players would look extremely stupid.
