    It can still be in his hands. He just has to be in the act of shooting.

    The reason they phrase the rule this way is to benefit the defender (not the offense), to make the ref stop the 3 second count. Look at it this way, if someone is in the process of jumping to shoot, why should the defender have to jump out of the lane and give up rebounding position.
