cson, Sounds like your rates may increase after this. Did you ask an attorney about this? Just because a company posts 'we are not responsible' , does not mean that they aren't. You should ask an attorney. If they had possession of your car, sounds like they're liable (but I am no attorney).
One question did they have you sign a contract? If not they very well could be liable for your car, small claims court might not be a bad idea like what every body else has been saying on this board talk to an attorney
cson -- I know of a good mechanic in Austin. My brakes went out while I was visiting some friends there about a year ago. They had me in and out in a day. They also called me in when they had my wheels off and showed me exactly what was wrong and what it would take to fix it. It wasn't cheap, but the work was of good quality and I know for a fact that I did not get screwed. If you're interested, drop me an email at Lynus302@yahoo.com.
I agree. Unless you signed something saying they were not liable, then I think that they are, in fact, liable.
You know, it seems to me that if PepBoys can't be held responsible for damages that happened to your car while in their possession, we can't very well hold them responsible for any repairs that took place, now can we?
Even if you signed a contract, 'catch-all' phrases denying all responsibility are not defensible in court. Also, from my BLaw prof, if you ever happen to notice disclamier signs (out of the corner of your eye) or if there is writing on a claim ticket, never read them.
