Wow, that really sucks. I hate it when things like this happens. Like Ziggy said, I hope you still have time to hire a lawyer and take them for all they got.
Thanks for the concern and I will definitely explore all my options, but honestly....just getting this all over with would be fantastic. I'm pretty sure my insurance company has "first time accident forgiveness" so I worst case scenario I can bank on that. I just want some answers. I really fail to see how any intelligent person could conclude that this trucker nor the borough in which this happened (with the broken traffic light) are 100% blame-free.
Wow, that sucks. Sorry to hear that. I was in the same boat, too the Henderson PD almost 3 weeks to get my police report done. Last friday I got a call from Enterprise saying the other guy's insurance (guy at fault) stopped paying for the rental. I was like WTF....and 5 min later the other insurance called me saying they are marking my truck as a total loss. So basically, they called Enterprise first to get their name off the rental so they didn't have to pay anymore, and then called me. PRICKS! Now I'm driving around the rental, out of pocket, going to head to Houston on the weekend to find another vehicle (from Nacogdoches).
In the tally of results, the difference between "rich" and "poor" is a far more powerful factor than the difference between "wrong" and "right."
I don't really understand this. If I were a witness to an accident and a bunch of shady characters started calling me trying to get me to not give a statement, I'd be more ready to testify than ever. What could they possibly do these witnesses? Are they threatening them in some way? These people just can't not answer the phone when these dudes call? Besides, it would probably give me some small measure of satisfaction just to slam the phone down on these guys when they called.
This is the part I don't really understand. The trucking company and insurance companies fighting like crazy...makes sense. The truck driver lying...well, not very ethical, but not shocking. But, can it really be standard police procedure to get to the scene of an accident, note everything, take statements from multiple witnesses, then wait a month and try and get "official" statements. I can even understand an official report taking a month. But for the life of me, I can't figure out why the police would need to go back to get "official" statements. The "official" statements should be the ones they took, at the scene of the accident, when it actually happened, not days or weeks later. And if the witnesses wouldn't cooborate later what they said the night of the incident, it should be reported as such - "On night of incident, witness A said x,y,z. Went back 3 weeks later for follow-up statement, but witness had nothing further to say and couldn't confirm earlier accounting of events"...or something to take extent.
baller4life315, Have you contacted your insurance company? If so, they should be fighting on your behalf. That's partly what you pay them for. If you haven't done this yet, do so immediately.
This. I would not be surprised if some money changed hands under the table from this trucking company and the witnesses involved. Because as you say, it isn't that hard to just stop answering the phone when the PIs or the trucking company call you to harass you. That would just convince me to bring them down even more. But if they suddenly offered $500 to change the story...well, that wouldn't surprise me at all that witnesses changed their tune.
Yea, one might be a fool to not wear a seatbelt, but you would be an even bigger fool to pretend you have the road all to yourself and not be aware of other drivers.
That's what you get for stopping. If your not gonna look, it doesn't matter if you stop. I still blame the 18 wheeler. They should never run red lights, especially since they can see everyone clearly from that high.
Im glad that you are ok now, and I second the comment about the seatbelts, it had saved a lot of lifes.
