    Many states still have common law marriages. They are just as valid as state certified marriages. Can cause some real problems when common-law "bigamy" pops up. Drop one "girlfriend" and pick up another "girlfriend". Cohabitate long enough, put yourself out as being married, and they can both count as common law marriages. But common law marriages still require a legal divorce. There is no common law divorce. Then you die with two "girlfiend-wives". Who were you actually married to?

    My guess is your mother.

    But really, the first wife gets everything because you were never really married to the later wife (unless it is in a state like NM, then the last wife wins). I believe the same thing happens if you were married by common law, don't divorce, and then enter into a state certified marriage. The first wife still wins in many states. Also, if you "common-law married" in a state that recognizes common law marriage and then move to one that does not, the marriage has to be recognized by the other states with few exceptions.

    BTW, neither New York, Minnesota, or Wisconsin recognize common marriages.
    California does not anymore, but Texas still does.

    If Spree was in TX, she wouldn't get jack squat for standard of living. TX is great that way. Just half the estate. That, along with no state income tax and homestead exceptions is probably a good reason so many athletes like to live in TX. If Kemp had lived in Houston and gotten TX laws applied, he would probably still have some money.
