To the original poster - contact the seller (or his lawyer) and state that you want his acceptance of the $50 refund in writing. In same letter, the seller should state that by accepting the $50, he is releasing you from any other or further obligations to him regarding the sale of the phone. If you get this from him, it may save you some grief in the future if he decides he's unhappy with the phone and tries to milk more money out of you.

He got your number off of the cell phone's memory... He has your name from the postage. Dude, tell him "NO." Take the negative feedback he leaves, bomb his with negative in return, and live happily ever after. Not worth giving him a refund. And this, boys and girls, is why it's good to 1)double check your listing, 2)have a ebay selling service handle your sales, 3)erase your phones memory before you sell it, 4)just respond with "bring it" when someone threatens a law suit over less than $500. You got served/hosed/screwed/taken/tricked/whatever you wanna call it.
Wow... Comon man, use your head for minute. Why in the world would a lawyer call you. You know what you should have done. Give that "lawyer" the number to your "lawyer" and have him discuss this. Be smart.
Right? And furthermore I'd be proactive in reporting this ebay bully to the ebay authorities. This is cyber-extortion in so many words.
Don't lawyers send legal letters first in the mail? I've never heard of a lawyer actually calling another party right from the beginning. Tell him to send you a letter with the stipulations of what you have agreed on.
