Offer him a full refund and say you will pay for return shipping. It is that easy. I understand that you put used in the condition column, but you stated four times in the auction that the phone is brand new, which is inexcusable.
I scanned the ad a couple of times looking for the word 'used.' and couldn't find it. Did see BRAND NEW in big letters repeated a few times though. Practically, he's hooped. You lose your whopping 9 feedbacks, and he puts his 139 at risk. Lawyers don't answer their phones for a $500 case. If you've any pride, however, you offer him back his money and pay him the same shipping fee you charged (pretty close to $30). Or you appologize for your error, offer him $100 and see if he accepts a used phone at that price.
is the phone in like new condition or is it scratched? even if you do nothing i'm almost 100% sure the worst you'll get is negative feedback, but you should do the right thing and refund his money anyways. there's no way this dude has a lawyer unless it's like his best friend. a smart buyer would have seen the used tag and asked you but you're at major fault for having brand new pasted all over the place. anyways if you do work something out, this should all be handled through paypal as they can mediate the process and make sure the phone is actually returned to you and he actually gets the money back.

He's full of crap. He got a phone that was worth the price he paid. I read somewhere that if you pay for what something is worth, you're good to go. If you want to do give him his money back, offer him the full refund including shipping. Then have him ship back the phone to you with a tracking number. Tell him you will refund the money after you receive the item. As soon as you confirm he has shipped it, put the phone back on ebay. Hopefully it will sell before it gets back to you. Make sure you sell the phone for the price you are refunding him. Use buy it now to guarantee the price and fast payment.
My thoughts exactly! As long as you offered the full refund and shipping costs you have nothing to worry about. Just be sure to keep that email. There are too many things that point to him bsing: 1) You offered a refund, he can't get anything more than that by taking you to court. 2) Lawyers won't go to court for such a little amount....I'm probably wrong, but wouldn't the worst thing that could happen be the court forcing you to pay him the difference between what he paid you and the cost of a new phone? So about $115? 3) He still got a good deal as long as the phone works and doesn't have any scratches. 4) Yes it's mostly your fault, but he is partially at fault as well for not fully reading the description. 5) Bottom line....he loses money and time by going through with this. I'm curious to find out what happens....my guess is you never hear from him again and he keeps the phone. Pugs
He mails me this morning that he wants a full refund provided i pay him the money + shipping & handling. he wants me to do that first. and when he receives the payment, he'll ship it to me with the shipping option of his choice, (basically the cheapest one). But if I do this, I'm losing $15 commission ebay charged on my account. And relisting it and selling it again will again end up in a $15 commission.. I replied, if hes fine with me giving him a $50 refund for the phone being used, $435 is not a bad deal at ALL. he hasnt responded yet. lets see what happens..
You will not lose the $15 on ebay. You will only lose the insertion fee because you can reclaim your final value fee through a specified process. And you will not be charged an insertion fee again provided your item sells the second time around. So basically, if your item sells again, you don't lose any commission.
I wouldnt pay anything back until i got the phone back. he obvoiusly isnt goin to take this to court, he would be an idiot to do that

Tell him to ship it with tracking number, then you will issue refund as soon as you inspect the item and make sure it's in the same condition you sold it in. Listen to Fatty, he is on point 110%. He is BSing you on the "petty theft claim" and BSing you on going to court. It would be a CIVIL court, not a criminal court anyway. The most you would have to do is refund his money (and he would give you the phone back). A judge will try to put the parties back in the positions they were in before the transaction took place. Don't give him $30 for shipping unless you want to a) lose $30 bucks while he laughs all the way to the bank; or b) give him $30 for $5 worth of shipping. Tell him to send the phone back with a shipping receipt and you will refund him the purchase price + his shipping price. Or just tell him to go suck a fat one and you'll "see him in court." You won't even need a lawyer for this type of thing.
About the drums, it wasnt for me. Its for my roomate. I won the cellphone in a competition. There's no way i can afford to buy drums and and not that great fan of playing music. My roomate does it and its annoying.. As for the age, i'm 20.. turning 21 in April.
