How can they enforce a ticket for jaywalking? If you give them a fake name and say that you don't have any ID on you, how can the ticket be traced back to you?
I probably should've thought of that yesterday. Of course, they could probably either search me, or take my social security number down.
Technically, in Texas, it is also illegal to be out in public without any identification of any kind. I had a cop give me a hard time about that once as well. If this guy was as big a dick as he sounds, he might have taken RM95 in just for that.
Didn't you get arrested in Dallas? I thought only the Pasadena PD gave people the beat down and tried to drown them in the channel?
In regards to Miranda: From the internet, so it must be true... Note that one need not be Mirandized to be arrested. There is a difference between being arrested and being questioned. Also, basic questions, such as name, address, and Social Security number do not need to be covered by a Miranda warning. The police also need not Mirandize someone who is not a suspect in a crime. and... THE OFFICER NEVER GAVE ME A MIRANDA WARNING. CAN I GET MY CASE DISMISSED? No. The officer is supposed to give a warning of your right to remain silent and tell you that anything you say may be used against you in a court of law (your 5th Amendment rights) and that you have a right to consult an attorney, and if you can not afford one you have a right to have a lawyer appointed for you (your 6th Amendment rights) after s/he arrests you. Sometimes officers do not. The only consequence of failing to tell you is that the prosecution cannot use any of your answers to questions asked by the police after the arrest. Of more consequence in most cases is the failure to advise you of the state's "implied consent" law, that is, your legal obligation to take a chemical test and the results if you refuse. This can impact the suspension of your license.
I assume since you spent 7 hours in jail (some of which behind bars), you were in custody, and should have had your rights read to you. If you were not in "custody" then I believe you do not have your rights read. These are things you need to discuss with your lawyer since I also assume you will fight it in court. Is jaywalking the only thing you've been charged with? btw, how did you get out of jail?

edit - you don't have to answer if it's personal. I'm in a law class right now. Jaywalking is not an arrestable offense. So I'm wondering how it got from point A to point B.
You seem to be missing the biggest lesson here. She's breaking up with you because of your temper. You're not helping yourself by proving her right.
