got screwed over...do i have any recourse?

    Pole is right. If the bank told you that the check had cleared, and if you can notify someone at the bank to pull up their records for the day that they said the check was cleared, then they can not charge you those over the limit charges. My sister had some BS like that with her bank and she ended up getting every penny of it back. Walk into the bank, ask to speak to the bossman, and tell him that if he doesn't refund your money from a mistake they made then you're going to take things to the next level and let the law handle it.

    better yet..tell him you're closing your accounts if he doesn't make it right. banks hate to lose deposits. which bank was it by the way?

    on a sidenote..i know you all love the convenience of a washington mutual or bankamerica...but i'm telling you, when the crap hits the fan, you want a local bank who actually values you as a customer. go with a sterling..or southtrust...or soutwest bank of texas..or bank of texas...

    yes, i threw in some of my clients there...but those are all good banks...local...and much more customer friendly than the big boys.

    If it is a bank like WaMu, they probably won't care to lose an account that is within $150 of being negative. Even so, raising hell at the bank is always good fun. Raise your voice enough to have the security guard draw near but not so much as to get yourself thrown out altogether.

    Depends. Most banks will "clear" a deposited check for you within a day as a courtesy. In reality, it can take up to 2 weeks for the person's check to really clear, ie. the bank to actually recieve money from the owner of the check.

    Most likely, the bank gave you credit for the check before they actually recieved the funds, then when they didn't recieve the funds, the shi'ite hit the fan.

    Unfortunatly, you may not have a leg to stand on unless you have bu ku dinero with your bank. Otherwise, they don't really care. Especially if it's one of the "big boys".

    update:


    well i just got back from the bank. what they said is:


    i deposited the check on 4/30/2003. they issued credit on the check immediately. however, on 5/5/2003, the checkwriter's bank rejected his check. that is when they took the money out of my account.

    i got all the way to the branch manager before finally being told that they would refund 2 of the 9...that's right...9 NSF charges. now, that pissed me off even more, because just yesterday as of 11:59pm, they told me that it was 7 NSFs.

    i told her this and she said, "that's true, but you have 2 more charges pending for today." of course, i had a check for about $1000 on me ready for deposit. so my question to her was "if i'm depositing this check right now, and it's going to clear today, why am i being charged for the 2 NSFs that are scheduled to clear today?"

    her answer was that "they actually were processed yesterday, but were being charged with NSFs as of today". f*cking bullsh!t.
    i think she saw how pissed i was about to get, so that's when she offered to rescind 2 of the NSFs .... yeah, the two that were allegedly going to clear today.

    i, eventually, just got pissed off and decided it was best if i didn't fight it anymore. just grab my ankles and try to relax my sphincter.

    ...no vaseline, man. no vaseline.


    ...i'm still very sore about this subject... :mad:

    btw, it's Compass Bank in San Antonio.


    maybe i'll switch to Broadway Bank or something... maybe they'll give me a kiss before they run it up in me...

    I would write a certified letter to the guy who wrote the blank check, and tell him that he has 10 days to pay you your $550.00. If he doesn't pay you, then turn the check over to the D.A.

    He gave a check to a stripper for $150, and then didn't follow through on his promise to pay the check. He is responsible.

    Verse, don't let these two walk all over you. Take back what is yours- that is the RIGHT thing to do.

    update #2:


    i forgot to add that the bank will be receiving the check back on next monday or tuesday. assuming he did not cancel the check, and that the account is not closed, i can go to his bank and try to cash it as many times as i want....or until he has the $$ in his account.

    that's an option, but i hate to go out of my way because some prick wrote a rubber check.

    that's not a bad idea, really. it doesn't cost me anything but the price of a certified letter (about $5).

    Didn't you say the check's "payable to" name was originally blank? If that's the case, the check isn't worth the paper it's written on.

    Just playing devils advocate. Actually, more like strippers advocate. :D

    That's the reason I still bank at Amarillo National Bank even though I don't live anywhere near Amarillo anymore. The only thing is the extra fees (roughly $2.75 total) for getting cash out of non-ANB ATMs.

    But it's worth it when I do need something taken care of because they do go out of their way to make things right, without a fuss even.

    Sterling is a good bank. So is Southwest Bank of Texas... they have good rates and great privledges to their customers.

    Its bad you have to put up with bull**** like that Verse. Nice guys always finish last, but you cant help to be a nice guy. I would'e probably done the same thing. But like I like to say... "f*ck me once, shame on me, f*ck me twice, shame on you" Your ex f*cked you once, then she got that John Doe to give you a bad check to f*ck you again. I'd go take it out of John Doe's a$$.

    I totally disagree.

    His intent was to allow the woman to spend the $150 any way she wanted. He is the irresponsible party, and he needs to own up to his obligation.

    Or even better, a Credit Union (if your co. has one). Credit Unions are usually small so they will bend over backwards to help you and make things right. You don't get caught up in just being a number.

    This figures. My wife was the branch manager for the Compass Bank in the Heights about 2-3 years ago. She ended up quiting because they had so many piss poor policies that they made her enforce which caused her branch to lose customers.

    i'd be pulling my accounts quickly...there are lots of banks that will treat you far better...and will be happy to have ANY new deposits.
