Two Conservative Law Scholars Conclude That Trump's Role---Leading to the Jan 6 Inrrection---makes him ineligible to hold government office

The professors are active members of the Federalist Society, the conservative legal group, and proponents of originalism, the method of interpretation that seeks to determine the Constitution’s original meaning.nn
they wrote that the original meaning of the 14th Amendment makes Donald Trump ineligible to hold government office.

“It is unquestionably fair to say that Trump ‘engaged in’ the Jan. 6 insurrection through both his actions and his inaction,”, according to the two conservative scholars.

wrote that the original meaning of the 14th Amendment makes Donald Trump ineligible to hold government office.

Prominent conservative legal scholars are increasingly raising a constitutional argument that 2024 Republican candidate Trump
should be barred from the presidency because of his actions to
overturn the previous presidential election result.

Couy Griffin was removed as a commissioner in Otero County, N.M., and barred from seeking future office by a state judge in September after being convicted of a federal misdemeanor for entering the Capitol during the riot on Jan. 6, 2021. Griffin, co-founder of a group called Cowboys for Trump, aided in the attempted insurrection by “joining the mob and trespassing on restricted Capitol grounds,” said Francis Mathew, a judge in the state’s First Judicial District.

Griffin’s case shows that no federal insurrection charge or congressional vote is needed to prohibit Trump from running for president, said Donald Sherman, executive vice president and chief counsel at Citizens for Responsibility and Ethics in Washington, or CREW, which filed the case against Griffin. He said a half-dozen former Confederate officials were disqualified from office in similar cases after the Civil War.

“The indictment is further proof of what the Jan. 6 (congressional) committee laid out and what we saw with our own eyes and ears: that Donald Trump incited and engaged in an insurrection against the Constitution of the United States by trying to overturn a free and fair election,”

Conservative Judge Michael Luttig and Law Professor Laurence Tribe make the case for Trump’s disqualification from public office

Section Three of the Fourteenth Amendment is also known as the “disqualification clause.” It’s only two sentences long but it could doom Trump’s bid to return to the White House.
The disqualification clause “forbids the former president from holding the office of the presidency again because of his conduct in and around January 6, 2021,” says Judge Luttig. And as Tribe points out,

    Either:

    1. This gambit works and we have widespread violence and demonstrations from Trumpers who feel like they've been robbed of their political voice, or

    2. It fails and it's just another Trump talking point about how the Demoncrats try to lie, cheat, and steal their way to an election victory.

This is just a terrible idea, and even as political banter it helps Trump more than hurts him.

Griffin was convicted of a crime, at least, which gives judges an opening into abridging one's rights. Trump still hasn't been convicted of anything in a federal or state court. A judge won't have an opportunity to bar Trump from office without a conviction, leaving any such action to an executive branch appointee. I can't think of anything less democratic than an unelected agency chief deciding who is on the ballot without any precipitating decision by a court or a legislature. I'd hate for this to be a precedent we set.

How about this: We send them to the election and have Biden beat him again. I know it's scary, but remember that over half the country hates Trump's guts and Biden won comfortably in 2020. Not to mention what a drag Trump was on the midterms in 2018 and 2022. I know I have too often made the mistake of overestimating the American voter, but I can't help it. We've got this. It's a layup. Biden will beat Trump straight up. And, if we somehow elect Trump anyway, we don't deserve nice things.

after the weakest Speaker of the House ever was fired, the insurrectionst-in-chief endorsed Jerk Jordan, allegedly a co-conspirator to the 6 Jan insurrection, to be the next speaker.

But the House Republicans voted for the Jerk's competitor; Scalise secures GOP Speaker nomination

a resounding FU to the insurrectionists !

This should go well beyond Trump, as a couple of you have mentioned. Guys like Jim Jordan and other far-right, criminal, radicals, should be outlawed from serving due to their support of the insurrection and who knows what other crimes.

The mortgage on the trust-fund baby’s Manhattan tower at 40 Wall St. has been transferred to a special servicer.

A New York judge had issued an order earlier to dissolve some companies owned by Trump. That was temporarily delayed last month by an appellate judge as the civil fraud trial continues in Manhattan.

The mortgage on 40 Wall St. has a 3.67% coupon and matures in July 2025, according to loan documents. The tower’s occupancy rate dropped to 77% as of June 30 from 98% when the loan originated in 2015.

A damning anti-Donald Trump leaflet has been distributed by Americans for Prosperity, one of the most influential conservative organizations in the U.S., which is urging Republican voters to choose an "electable" alternative to the embattled former president.

Americans for Prosperity, also known as AFP, is a libertarian conservative political advocacy group affiliated with brothers Charles Koch and the late David Koch, who died in 2019. The family is among the richest in the U.S., and the two brothers together built an important network of conservative and libertarian donors.

While Charles Koch and AFP have never been supportive of Trump—in 2016, AFP sponsored training to counteract the rise of Trumpism within the GOP and the conservative movement—the group had previously never gone as far as to actively campaign against him, as it is doing now.

I am surprised if anyone out there is still undecided, if you're on the fence about trump then I have no clue what would change your mind either way.....if you can stomach the guy, a conviction isn't going to do much, to all the folks who say, "well, I don't like him, but inflation is horrible and I want a change", then vote how you like but don't be surprised when he turns the country upside down and then doesn't want to leave. The cult leader has already started lay a plan for all the people who have wronged him, listen to the man, he is telling you exactly who he is and what he will do, listen carefully.

    Nothing. It's cult mentality.

They don't care that he lied about COVID, lied about the election, incited a coup, tried to steal the election, incited those screaming to hang Mike Pence, stole boxes full of classified documents, then lied his ass off about having them, shared them with others, has bankruptcies out the ying yang, raped women, cheated on all his wives, perved over his daughter and teens at beauty pageants in dressing rooms, hung out with Epstein, committed tax evasion, stripped safety inspections and regs at workplaces, mocks people like a child, lies everytime he opens his mouth, got patents for his family off foreign leaders in China, is in bed with Russia's Putin for favors, got billions for his family from the Saudis, idolizes and coddles dictators, grifted from the government for 4 years by jacking up prices at his resorts for secret service, acts like a foul mouthed spoiled brat bully, laughed and joked about Pelosi's husband getting beat and attacked, called prisoners of war losers, makes white guys killing blacks heroes, pardoned a bunch of his friends & associates, who were white collar criminals, grifted from campaign funds and dumbass donors, left lawyers and people he contracted for his businesses stiffed without pay, spits on the military leaders who don't coddle his twisted ideas, and on and on and on.

Oh, but he's a man of God in their eyes.
    The chosen one.

In a stunning and unprecedented decision, the Colorado Supreme Court removed former President Donald Trump from the state’s 2024 ballot, ruling that he isn’t an eligible presidential candidate
because of the 14th Amendment’s “insurrectionist ban.”

    The ruling was 4-3.

The state Supreme Court decision only applies to Colorado but the historic ruling will roil the 2024 presidential campaign. It tees up an appeal to the US Supreme Court, which could settle
the matter for the entire nation. Colorado election officials have said the matter needs to be settled by January 5, which is the statutory deadline to set the list of candidates for the GOP primary.

Now is when the real fun begins. We all knew this was ultimately where this battle was headed, but somebody needed to trigger the whole thing. Now the fire is at the feet of the USSC, and we will finally see which direction they go.
