Yeah he was not in the shooting motion nor driving toward the basket when he actually got hit. The refs don't give calls like that, especially in that situation.

What text book are you reading? I've watched a lot of basketball, and I can safely say I have never seen a team up 3 with 30 seconds left intentionally foul. That's way too early.
