How do you know there wasnt? Just because he said so? If the state doesnt require to tell you why you are terminated then they dont have to. He could have **** in someones hat and put it on their head for all anyone knows. Maybe a cost cutting maneuver, maybe his work wasnt good enough, customer complaints, or maybe it could be discrimination on him and then he would be justified. I was fired from my job for NOTHING but I do realize they HAD to fire me to save face. Over the summer a co worker hit a child, a big no no where I worked, and me and him and a fine young lady who also worked with us in the same room all got fired. Him- Hitting a kid. Me- Excessive Cell Phone Use (WTF right?) Her- Something as strange as mine. They HAD to fire the two innocent parties because the News (ABC 13) was called by a RANDOM parent and to look like they did something they fired us unjustly. Like I could freeze time and tell him not to hit the kid while I was halfway across the building... too bad I cant play the race card.
I have no idea if he was fired for his race or not and neither do you. I'm just responding to the assertion that he (or anyone else) shouldn't fight it if they were. It is against the law to be fired because of your race. If that is the case in any case, then it should be fought if that person wants to fight it.
Besides, it's not up to us whether or not this dude has a case, or whether or not he should take them to court.
I agree. I don't know how anyone here can make a conclusion either way (wink2moochie07) considering how little we know of the situation. Hopefully Lil Pun gets some info and his friend can make the appropriate judgment call.
Here's what your friend needs to consider: What evidence does he have that proves he was treated differently because of his race?
This sounds like a pretty interesting retaliation case. You can't fire someone as retaliation for complaining about racism on the job unless you can prove you would have fired them anyway. He should talk to an employment discrimination lawyer to see if he has a case.
Not sure. I'm not entirely too sure of all the details either. I probably will get to hear the recording sometime, maybe even tonight. The main reason I started this thread was to see if Arkansas was one of those states where an employer could fire you and not give a reason, and what that is called. I can't remember but I know I have seen it posted on this board before. The other reason was to see if that recording is even admissible since only the recording party knew about it. Like I said, this was never for legal advice.
