Fan sues Dallas Cowboys for ‘burned buttocks’

    This is a bit stupid...who doesn't check a bench before sitting on it in the August Texas Heat?? She must be the same person that would put her kids on a slide at the playground in the middle of the summer without checking to see if its hot first.

    That being said...how dumb is it that the Cowboys would put BLACK Marble benches OUTSIDE their stadium..knowing black attracks heat.

    My guess is we'll soon be seeing warning labels beside the benches.

    Fail on Both sides..but a lawsuit is just dumb.

    Less than a month ago, the Dallas Cowboys found themselves dismissed from the lawsuit several fans filed as a result of unfavorable conditions at Cowboys stadium during Super Bowl XLV. But it didn't take long for Jerry Jones' franchise to find itself right back on the hot seat -- this time, quite literally.
    According to CBS Dallas, "Jennelle Carrillo, of Cleburne, received severe burns to her backside after allegedly sitting on a bench outside Cowboys Stadium." Carillo filed a lawsuit in the District Court of Tarrant County, Texas as a result of injuries allegedly suffered when she sat on a black marble bench outside the stadium before the team's Clue and Silver Scrimmage in August of 2010. Cowboys Stadium, L.P., the Dallas Cowboys Football Club LTD, and one Jerral "Jerry" Wayne Jones are all named as defendants.
    Carrillo's attorney, Michael Wash, put it thusly: "She sat down on this black bench, outside an entrance and unfortunately she suffered third-degree burns as a result of it and had subsequent skin grafts." Wash said that his client was hospitalized for about a week.
    And as it turns out, Carrillo didn't even stay for the game. "She knew, while she was there at the stadium, that she had received some burns. But she didn't realize how serious they were until she received medical attention."
    The lawsuit states that "The bench was uncovered and openly exposed to the extremely hot August sun. The combination of the nature of the black, marble bench and hot sunlight caused the bench to become extremely hot and unreasonably dangerous."
    Wash claims that his client suffered mental anguish, physical pain and disfigurement as a result. She is not seeking specific damages, but would like a jury trial, and damages decided by said jury.
    The lawsuit also claims that the Defendants "breached their duty of care by both failing to make the condition reasonably safe and by failing to adequately warn the plaintiff of the condition of the bench when exposed to the hot August sun."
    Based on their 3-0 win over the Oakland Raiders to open the preseason, the Cowboys already have quite enough to deal with before opening the 2012 regular season against the New York Giants on Wednesday, September 5. The game will be at MetLife Stadium, which the Giants call home so there shouldn't be any repeat incidents of 'burned buttocks" among the attendant fanbase.
    As defending Super Bowl champions, it's assumed that the Giants take care of the little things.

    Depends on how hot. If she sat entire game, her fault. If we are talking seconds, cowboys fault.

    I wish I could get on that Jury. I would do everything possible to ensure that she not only lost but was held liable for waisiting the tax payers money.

    If the bench is hot don't sit on it. If you do, get your ass up.

    whats next? her suing the company that made her stove, because it was too hot to touch it, and now she burned her hand? :rolleyes:

    i'm not at all surprised here, seeing that a lawsuit may have come up for things like people not being warned how hot their beverages are..even though, they insist on ordering something hot in the first place..but hey, that's the world we live in!

    That's a case right there -- if you sat on the pavement you wouldn't instantly get 3rd degree burns requiring skin grafts.

    Sue the architects. We talk about exactly that in school at about the sophomore level. Benches are always hot but slatted wood and open web are cooler.
