Just for curiosity's sake, as someone who is currently attending law school and working on his second degree, from what I've been able to understand reading the posts, it seems that you guys in the good ol' us of a are still stuck with the ages old understanding that a child should stay with his mother, unless there is something really serious that advises against it. I'm asking this because here in Brazil it's not about a mother's right to be with her child, but about what is in the best intersts of the child. If the father is able to provide better conditions for the well being of his kid, there's no understanding at all that the mother is the first option. I know you guys have different laws in each state in certain matters, so satisfy my curiosity if you can. Here in Brazil Eddie would easily win in court, if the situation really is as we've been told.
Technically the courts are supposed to decide what's in the best interest of the child but more often then not they lean towards the mother. There are exceptions and I think things are changing as society changes
I agree with rothdaniel about the US courts. But thanos, don't assume Eddie would get the child automatically if its best interests were considered. I once served as a juror in a horrible custody case. I spent a week hearing two human beings trying to prove one another to be incompetant, lecherous, and evil in court. I never thought anything could get so ugly. (Well, actually, it was a lot like watching some of the political threads in the D&D forum, but I digress). So I'm sure the mother's lawyer would have a field day with Eddie's drug violation, his violence against a college teammate, et cetera. Blech.
Are we even sure there will be a custody battle? Eddie is in a bad situation, he probably wants to see his kid all the time (if not custody), but being on the road half the season, and all the time with the team probably isn't something the courts want to hear. I could be totally wrong though. I hope everything works out for Eddie, if not for the Rockets, atleast for himself. Sleepy-trading Eddie right now would only hurt the Rockets right now. There is probably not a single team that wants to trade for Eddie right now, I still think Eddie will come back and play for us, then maybe trade talks can come in, but I can safely say that Eddie is untradable right now.
Makes sense now...Eddie quits basketball the greedy Ho does not get the $$$$ but a basic child support. I have to side with eddie on this he values his daughter more than basketball. That is a good father
The situation between Eddie and the mother of his child isn't about custody. Eddie just wanted to see his daughter. To say that she is a good mother would be a stretch, I wouldn't want her taking care of my child, but she does have the right to the child just a much as Eddie. I do know that she is already receiveing checks from Eddie. Jessica filed a harrassment report on Eddie that night(10/12)and tried to file a charge of assault, but the police found that there were no ground for that charge. Eddie and Jessica are back on speaking terms, but he wants nothing more to do with Jessica, just the baby. He knows she pulled one on him. From my source, she is a "volcano waiting to erupt" and "quite street-smart". But the situation is improving...very slowly, but in instances like this, slow is the only speed to go. Also, Eddie is in daily contact with the ballclub and will rejoin the team soon possibly before opening night, of course barring extenuating circumstances.
Oh, I didn't mean to assume that. That's why I used "would." I was just trying to answer a question about US courts and thought my bizarre jury experience would be worthwhile.
less sympathy? let me tell you something, JeffB. f*** with a man's child/children and, as far as i am concerned, all bets are off. suddenly, terms like "right and wrong" get skewed...largely because it's one of the few things that are almost guaranteed to put a man in a truly *emotional* state of mind. rational decision making is extremely difficult at times like this. it's difficult for me to fathom being in this situation, however, i can guarantee that the sight of a someone with a weapon in the viscinity of my child...my 6 month old newborn at that..., with the gall to prevent me from seeing my daughter would most certainly put me in a different state of mind. at that point, for me, it'd be f*** basketball, f*** my job, f*** the so-called "fans", and f*** anyone that isn't trying to help me resolve what is surely an unsafe environment for my child. less sympathy? what do you think these players are? GI Joe action figures that serve no other purpose in life than to fulfill your entertainment cravings? it's cool to enjoy the sport of basketball, and to look at it from an entertainment viewpoint or a business standpoint. but to say you have "less sympathy" for him, is, imo, so far out of bounds that i personally got offended by it. if you meant something different than how i interpreted it, fine. i'll retract my comments. if not, all i can say is, don't reproduce.
I tried looking up some specifics you listed just to see. I can't find a street called Harrisburg (Mapquest) in Philadelphia. Are we talking about Philadelphia? I tried to look up the beat report for the 10/12 charges you say she brought but the Philly site isn't as transparent as the Houston one in that regard. And, I found that Jessica Jimenez is the name of a soap opera actress (information was sparse on her so I couldn't figure out if she had a Philly connection or a Eddie Griffin connection). Of course, there's no particular reason why one should be able to google the chick. Anyway, I was just seeing what I could find to confirm the story. Not being able to find a Harrisburg in Philly has me scratching my head.
Problem One: EG unfortunately is money rich beyond his childhood imagination but equally unfortunate he is also very young and socially naive. He happens to think that when he became a father, and realtionships are not well with the mother of the child, buying a new home with those hopes of feeling more familiar/"on track" - a la family life - well ... that may not be shared by everyone involved. Problem Two: When you start to get in over your head, and start to miss work, do not return calls to your employer ... you will eventually increase your problems. This does not improve your chances of finding answers to Problem Number One either. Problem Three: In the middle of all this EG is trying to force management to consider him for a long term contract, give him an established starting role OR move him somewhere of his choosing for a substantial increase in both playing profile and salary compensation. Did we mention the word - naive. Mr J Van Gundy's point is well taken. He wants to know what is going on with his players because it affects the team. By not telling him what was happening, EG left himself vulnerable for all the criticism he received. The "no excuse" is correct. It was not that he had an excuse, or a perfectly plausible explaination, just that he did not share that explanation in a timely fashion. EG - indeed take the time to get your head staright.
