The transition will happen but this will just embolden those who don't accept the election and those who haven't been paying attention who will see Senators and Representatives claiming in Congress that the election was stolen. This will become a self-fulfilling argument, "Well if the election wasn't stolen why did so many people in Congress say it was?" It means more division for the country and not just in terms of arguments over things like how big the stimulus checks should be but in actual faith in whether the presidency is legitimate or not.
The US Constitution elections clause, if read in the most narrowest of interpretations, which isn't the case with SCOTUS. The problem with this logic is that many other states (Texas, North Carolina) amended rules in the same manner, but the Republicans are only challenging the states they lost. They will continue to lose based on standing, latches, stupid remedy sought, all merits, and the Constitution. They're trying to take one part of the Constitution, interpret it differently, and blow up the rest of the Constitution - it's just childish on an intellectual level, including selfish, dangerous, undemocratic, and everything else.
is it this? "The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof" so the rules PA implemented were not presribed by PA state legislature?
I've lost track in all the lawsuits, but yes, this is a main concept. A strict reading would imply things like Abbott extending early voting as unconstitutional.
What's ludicrous about this is that the PA legislature did pass Act 12 and Act 77 in 2020 to make changes to the election because of the pandemic. https://en.wikipedia.org/wiki/2020_Pennsylvania_elections Election law changes for 2020[edit] On October 29, 2019, the Pennsylvania House of Representatives passed Act 77 by a vote of 138–61.[5] Later that day, the Pennsylvania State Senate passed Act 77 by a vote of 35–14.[6] Governor Tom Wolf signed Act 77 into law two days later.[7] The law enacted numerous changes to Pennsylvania's election code. Voters were allowed to request a mail-in ballot without providing a reason.[7] A person could register to vote up to 15 days before an election and vote in that election, instead of the previous 30-day period.[7] It said that mail-in ballots and absentee ballots would be valid if received by 8 p.m. on election day.[7] The law eliminated the option of pushing one button to vote for all candidates of the same party, called straight-ticket voting; instead, a voter would need to select each candidate in order to vote the same way.[7] The law said the state would cover up to 60 percent of the cost for counties to replace their voting machines with systems that had voter-verifiable paper.[7] Governor Wolf described the changes as the "most significant improvement to Pennsylvania’s elections in more than 80 years".[8] In response to the COVID-19 pandemic, the Pennsylvania House of Representatives and the Pensylvania State Senate both unanymously passed Act 12 on March 25, 2020,[9][10] and Gov. Wolf signed it into law two days later.[11] Act 12 delayed the primary election from April 28 to June 2. Act 12 also allowed counties to begin counting ballots at 7 a.m. on election day rather than being required to wait until 8 p.m. to do so.[12]
At one point before the election, Trump’s twitter account featured a tweet that promoted Trump 2024, Trump 2028, etc. I’m sure a lot of naive people thought that it was a joke, and Trump wouldn’t dare try to eliminate term limits for presidents. Clearly, it wasn’t a joke. Instead, it was foreshadowing Trump’s vision if he was reelected. Electing Joe Biden saved America from Donald Trump trying to use the next four years to become an autocrat like his best buddy Putin. I’m grateful that enough Americans wised up before it was too late. The sad thing is if the pandemic never happens and Trump’s callousness and lack of concern and empathy for those that lost a loved one from COVID-19 isn’t exposed for all to see, Trump probably skates to reelection, and democracy in the country might be dead for good.
I suspect that the number of republicans signing onto the "protect American Democracy" group will be growing after the trump tape was released...
Now we know what the **** this bum has been doing for the last two months that he should have been running the country.
