This is intersting, if it was done at home on his home computer.....then I think he may have a case against the Eagles, with Freedom of speech etc... Now if he signed a contract saying he wouldn't speak publicly then all bets are off....but he may have a case. DD
He's not the first person fired for something said on the internet and won't be the last. I've known a couple people personally fired for stuff written on blogs. There is no such thing as freedom of speech if you are bad mouthing an employer. Stand up and say, "this company is r****ded" and see what happens.
I think we're saying they have no legitimate reason to fire him. If you're drinking with your buddies at a bar and you say, 'Eff my employer' and you get fired for it... is that good reason? You're not on company grounds. You're not at a company function. At what point can you live your own life. Then again, in an At-Will state you can quit for whatever reason too.
I have a feeling that most companies would fire an employee if the employee wrote something bad about his company on facebook.
Freedom of Speech doesn't apply. He wasn't arrested and taken to jail. He put his own words on the Internet for everyone to see. Employers use facebook/myspace has sort of an investigating tool nowadays anyway. Don't forget about that Texas football player that made a racial statement against Obama on his status and then was kicked off the football team.
So where does freedom of speech end? I'm not trying to turn this into a D&D conversation either because I would really like to know. Why? Because I was always curious about how players and coaches in the NBA get fined for talking about the officiating because I thought it limits free speech. I then thought maybe there is something in their contracts but then wouldn't the contract be unconstitutional? It's confusing to me to say the least.
No, it means that they don't have to have a reason to fire someone. They didn't like something that he was doing so he is now no longer employed by the Eagles. Personally, I think it is petty.
Players and coaches can say absolutely whatever they want without worrying about being charged for a crime and imprisoned. However, the NBA has every right to make their own statement and fine them. The players could still talk if they wanted to, but losing cash probably corresponds to losing motivation to make a point.
Really sick of people using freedom of speech as an excuse for saying stupid ****. You can't publicly call you're employers "retarted" and not expect to get repremanded or fired. If I did that at my job I'd get fired too.
It's the company's perogative. However, what is 'public'? What about your local bar? What about at lunch with co-workers venting? A Facebook profile? What if your profile was private?
This had nothing to do with his employer....he was just a really big fan of the eagles and was showing his passion... true fans get mad when their team makes a dumb move....he was not saying anything about the organization, that was just his point of view as a fan and a lot of Eagle fans agree with him also Considering he had been there for six years, this is a really unfortunate situation for him
