I got a DUI about 7 years ago in a similar situation. Did some shots then left- certainly didn't feel drunk when I left, but was pretty silly when I got pulled over. Needless to say, it was a wakeup call and I haven't driven drunk since. That said, did they do bloodwork on you? If they have no breathalizer or blood info on you, it's your word against his, and the video tape. I took mine to court for a long time, and the only thing that got me was the breathalizer, because they couldn't find the tape. Although I think the DUI laws are good, you'll get hammered to a cross if you get convicted of one. These things are EXPENSIVE. If they don't have any physical evidence on you, get a lawyer. And make sure to never do it again so it at least counts in a positive way.
point wasn't that he was definetely drunk.. it was that he was "impaired" - i.e. sleepy and then buzzed. look i'm not looking to get the book thrown at him, i've just seen kids in the ER who were seriously injured by people who were impaired.
ugh, flashbacks. i got one about a dozen years ago when i lived in houston. seriously not fun. overnight downtown jail. i got lucky in that my license wasn't suspended, but i had to take a drinking education classes, 1 year probation and like 120 hours community service. not to mention the court costs, higher insurance rates, police record, etc. sufficiently inconvenient. good luck with it.
seriously, I was not drunk, if I was drunk I would not even talk about this right now... I was falling asleep, when he pulled me over, I was okay but when your tired, drinking does not help... it is going to be my words against his words and the video... I think I did really good on the video just did not pass the light test... the balance test, the walk test. I didnt even flinch...
yea, hopefully this is a good lesson for him...at least it'll be an expensive one. i was fortunate that it only took me growing up to realize how stupid i was driving impaired.
Your defense of being tired doesn't make it better, it makes it worse. I don't want you to go to jail or anything, but you could easily have been the guy who killed someone on the road because he was falling asleep and had mixed in a little liquor.
You need to wake up my man. Stop right now with the self-pity and denying. As already noted, being drunk is not the issue. You were impaired by alcohol. You were a danger to yourself and others. The cop was right and you were wrong. You were lucky to get pulled over when you did before something tragic happened. Take your medicine like a man and vow to do better in the future.

I was given the light test about 8 months ago and the officer kept trying to bait me because he kept yelling at me to stop moving my head but I wasnt moving my head at all I kept following the light and the he kept telling me to stop closing my eyes and follow the light and I told him the light was hurting my eyes since he shone it right at my eyes. I was blinded a bit by the light. I wasnt even close to being drunk or anything I was pulled over for speeding which I was doing. I had 1 glass of champagne and 2 beers over the course of 3 hours and I weight a considerable amount so to say I was even close to being buzzed would be a total joke. I told the officers I was at my friends wedding and driving back and I didnt drink much on purpose since I had decent distance to drive and I was just trying to get home quickly. The officer was a dick he was going to give me the breathalyzer too but I showed him the wedding invite and he was like ok so you werent lying. and gave me my speeding ticket and then sped off like crazy (i hate cops)
Are you implying that any of this crap you've been going through isn't your fault? You have a kid, buy a Lexus, and then complain to us when you can barely afford child support. Now you get pulled over for a DWI and come here to complain about it. You need to wake up dude.
you guys are right, Maybe i just want some pity.. I wasnt drunk but drinking most likely caused me to get sleepy.. what are my chances of getting it dismissed when i bring it out to court? thats the question... the same thing goes on here... I tell you guys what is going on and ask a simple question then gets bashed... I am not asking for pity guys, I just asked you guys what are my chances of getting it dismissed and i get hammered, just like child support, I told you guys i have 69 bucks left over each month, "how long do you guys think I will last before I collapse?" then i get hammered...
dont think you're gonna get a lot of sympathy from people when you are driving after drinking and putting peoples lives in danger. if you didnt wanna be blasted by posters, should have just kept it to yourself. just my 2 cents...hope everything works out
I think you have a pretty good chance of getting this dismissed since u said you did well on video and didnt take the breath/blood tests. But you are still going to have to get a lawyer, and in the end, this is going to cost you somewhere between $5-7k

I'm assuming you were videoed at County? Hire a lawyer, have him see the tapes of how you were acting, and have him figure out the best course of action. The tapes will typically let them know the best way to go about this. As for a good DWI attorney, I'm not sure. Ask some folks.
