I believe the ultimate goal of things like prison is to reduce crime. The question is how we do that. Prisons function to deter crime but for some crimes recidivism rates are so high that pure punishment via prison does little to prevent repeat offenses. Additionally, prisons are so crowded today that people who should be in prison get let out early and recidivism rates for those individuals then become astronomical.

Thus the old saying as to whether or not we should focus more on rehabilitation and for certain crimes I believe we should. For example, jailing a pedophile is pretty much worthless. Pedophiles have off the chart recidivism rates that actually increase every time they are jailed. Thus some sort of rehabilitation program for pedophiles would probably be more effective than just jailing them over and over again, only to have them commit an offense each time they get let out.

Most inmates at some point are returned to the general population. Do you want them stealing your car or fixin' it?

The true purpose of torture is to express hate and fear. The torturers are also the victims. Their actions will continue to disturb them long after the abuse has ended.

Hahahahahaha. Definitlely works? That's odd, because most scholars I learned about in law school disagree as to the issue of the deterrent value of the death penalty and tend to feel that on balance, the statistical evidence tilts the opposite way.

The most preeminent person I have recently heard from on this is Professor Fagan from Columbia who has pretty much (under oath) disemboweled and eviscerated the recent studies you speak of: http://www.deathpenaltyinfo.org/MassTestimonyFagan.pdf

At best, the evidence is mixed, but arguing that the consensus "definitely works" in terms of deterrent value is simply not a credible statement.

Where do you go to school nomar? Is this the same school where you definitely learned that smoking isn't harmful to one's health?

I'm in favor of the death penalty, but I really can't support it due to the problems associated with it, mainly the cost to taxpayers. I think that the death penalty should only be given if the person either confesses to the murder or is convicted through DNA evidence, where there is no possible way he can be found not guilty later on. Also, the death penalty would be unable to be appealed, so that takes care of the cost factor. If somebody is convicted on Friday afternoon, kill 'em on Monday morning...

I'm also DEFINITELY in favor of public executions. Hell, put them on PPV and charge people to watch them. Think of the money that could raise.

    for the benefit of society
if you create a person that does not do crime it is better for society
contitioning of negative and positive enforcement

These folx must learn to act more discipline and in more acceptable ways
Is that not the purpose. . .to reduce crime
    by
    reducing the number of criminals?
