Yes, Cuban was able to go over the lux tax in the past to get player aquisitions but even Cuban himself admits that those days are over, and follow the exact same player aquisitions philosophy that Morey and the Rockets do now.
Those days aren't over and never will be until there is a hard cap and Mark Cuban knows this to be true as well as anyone. Certain teams are already in a position to decide to voluntarily pay through the nose on the luxury tax from time to time when it gives them a decided advantage over the competition. Nobody cares about paying $100M in luxury tax if it means having an extra superstar that other teams can't have and can't afford, as long as their franchise is already making 4 times that amount of money in a season anyway. What it boils down to is that certain teams are going to have the flexibility to decide to somewhat less profitable from time to time in order to guarantee their success. The only thing to prevent it is a hard cap. Not a luxury tax.
