Regardless once he’s there. He still has the right to preserve his life. Mob riot again is the danger
He was trying to evade till the riot mob left him no choice . Riot mobs are bad . Should he have been there? No. Should he had the firearm at his age? No. Does he still have a right to self defense regardless , ? Yes
We seen what riot mobs do. They tried to invade the whitehouse. They actually invaded the capitol ...they caused an atmosphere of thinking it’s a good idea to charge someone armed that was attempting to flee...mob riots are bad, dumb, and stupid. They lead to people getting shot . It’s bad
It's going to be an interesting trial, but if the first two things are proven as a "no", then the third thing equals a crime. It's akin to someone robbing a store with a gun, and then when the clerk pulls out a gun, the robber murders the clerk and claims self defense. To my knowledge, the robber has never win that case. It's not exactly the same, but if it's proven that he committed any crime by being there, it's very similar, imo.
I agree, he did not follow the law but that still does not absolve his right to self defense given the threat by the riot mob
I get what you're saying, but if he did not follow the law, it's technically not self-defense anymore. Just like when this woman was storming through an open door, a mere few feet away from elected members of Congress, trying to get to them, she lost the privilege of a peaceful arrest because of actively commiting a Federal Felony of the highest order.
Criminals still retain basic rights , including the right to life up until conviction or apprehension by legal authorities...genius
So if a thief breaks into your house, regardless once he is there, he has the right to kill you to preserve his life? Yours is a display of arrant stupidity.
Again, it’s still self defense if his life was in immediate peril which it was with the mob riots. Also keep in mind , the mob rioters were also not technically following the law by trespassing and destruction of property
Like I said, I get what you're saying. You're saying from a human nature, simple survival point of view, and we're talking from a lawful point of view.
The thief has a right to life up until his actions override another persons rights especially in a home invasion scenario
