    No it is not illegal-- at least in Texas.

    Sorry to tell you.

    I suppose it could be illegal in California, but I would not be so sure.

    There is no law prohibiting this.

    In a right to work state a person can be fired for any or not reason at all except for certain protected classes e.g. race, religion, sex, age ethnicity, because you are in favor of a union (though employers do it all the time as the remedy is so long in coming).

    Political affiliation is not one.

    As I said perhaps in some states it is illegal under state law.

    On the Federal level, I didn't think so. Perhaps Franchiseblade believes that anyone who opposes Obama is racist, so therefore he violated the race aspect.

    You're a lawyer, right? Come to think of it, this does sound like a shady lawyers twisted interpretation of the law. Forget comparing apples to apples ... this is more like comparing apples to WTF are you talking about?

    Yeah, that's what I believe about crticizing Obama. That's why I'm a racist because in the thread about assassinating an American citizen I was critical of Obama.

    Why would make a stupid assumption about me like that when it's proven wrong on this very page?

    Anyway it would be a violation if it was a first amdendment issue the guy was an employee or contractor of the govt.

    If he's not, then I could be wrong.

    Depends on how the law is interpreted. For example, if I (as an employer) tell all my employees that they have to vote for Obama or I will fire them, that is illegal. It's not illegal based on employment law, but based on voter protection law.

    However, this guy fired the Obama voters after the fact without trying to coerce them to vote a certain way, so it's unclear how this would be interpreted. It could be considered voter intimidation going into 2010 or 2012, for example, if employees believe their jobs are at risk if they don't vote a certain way. But I don't really know how that would play out.

    Yeah, crazy of me to find some way to distinguish political speech from mere beliefs, only something that courts have done for hundreds of years.

    Doesn't there have to be state action for there to be a violation of the first amendment? If it is a non-governmental employer, I think they can fire in this situation. Of course, it is a stupid reason to fire someone.
