I get the logic. But there's also a check in place if we ditched tips: the manager/owner of the restaurant can fire you if you do a lousy job. And the wait staff doesn't have to worry about getting stiffed. IMHO, I don't think the level of service would change dramatically. The logistical problem would be waiters wouldn't want to work at busy times. Conversely, retail sales has to deal with slow and peak periods, so it's not an alien concept. BTW, has shovelface donated money to the site or is he still freeloading here?
I tip every single time, but if you get some a**hole waiter i will show my dislike in the service by not paying. i mean if it is a contract then what is the consideration on their part, just giving us our food? A person should be able to breach the "contract" on the basis that the restaurant didnt hold up their end of the contract by not providing the service part. looking at it from a legal perspective. i mean all those ppl complaining about ppl who dont tip want to apply one rule to every situation. its not all black and white, there is a gray area and this example proves that point. I should be free to tip or not tip whenever I want. (disclaimer: I tip 99 percent of the time)
go to the new grocery store on I-10-Blalock Rd. Ranch 99 is very nice, clean, pack and CHEAP!!! lobster $5.99 lb and the food court says "NO TIPPING!!"
i use to work at a restaurant and minimum wage is required by law. in fact that restaurant got busted just before they hired me. i don't know how some places can get away with not doing so. service is starting to get crappy these days whether you tip or not because everyone just automatically expects it. i tip regardless, but varying amounts depending on the service and the hotness of the waitress. however, by definition, they should have to EARN gratuity. it's shouldn't be law unless it's listed on the menu as a service charge.

That's why I go to taquerias, the waitstaff there are always appreciative of whatever tip I give them.
I'm surprised Major, usually you are one of the more sophisticated posters around here... I would have thought you would be the type to have been to lots of places around the world. What you are saying is one of those things that seems right on paper, but in reality it's not that way. In every country that I have been to where tipping is not part of society, there has been NO general difference in service level. I definitely have never noticed it to be lower than here in America. In fact, again using Japan as an example... I would say their service level is better than 95% of restaurants here. How do you explain that? As some others have said in this thread, you really would not see any difference if we changed to a no-tipping society. It requires proper training of course and hiring the right mindset quality people. But that's no different than hiring employees in any other type of business.
It's so that you won't stiff the waiter a decent tip even if he does a good job bringing six plates of food, appetizers and soup/salad, filling your cups once or more, asking if you want desert so they can give it to you and other concerns you had with the food that might not be their fault. If you only knew how much they get paid base salary. On the flipside, because they get paid ****, you get to dine in a fine restaurant with cheaper price for food. There's always Burger King if you want to serve yourself your way.
