While I'm not too thrilled with the recent ruling about corporate election money, I don't know if Kerry-nominated supreme court justices would make me any happier. So, I won't lament the 2004 elections.

It seems to me that Thomas should have recused himself. I think the only recourse is a censure or impeachment by Congress. Impeachment will never happen, and is probably too extreme anyway. Censure is possible and appropriate, but I don't really see that happening in a Congress that can't even pass a bill with a near-super-majority. It'd be nice if the decision could be unwound and Thomas could be forced to recuse himself, but I guess that's not possible. In a 4-4 tie, the SC would defer to the decision of the lower court, which would have gone against Citizens United, right?

Democrats may end up liking this turn though. A lobby group like this will probably have its hands in a lot of pots, and they could be involved in SC cases in the future. Thomas would have pressure to recuse himself from future and highly-political decisions later.

Finally, I have to say my opinion of Thomas went down with this story. Given her chosen allegiances (tea party, rush, beck (though that could be simple propaganda tailored to her target audience)), I can't think much of her, and therefore less of Thomas by association.

While I generally say judge someone by their own deeds and words, guilt by spousal activity is also worthy of consideration.

My view of Thomas was not very good to start with, but I'm really shocked he wouldn't short-circuit this particular appearance of impropriety. I can't say I'm shocked he's married to someone who could support hate-and-hysteria merchants like Limbaugh and Beck though.
