Clemens v. McNamee: With Physical Evidence, who do you believe

    It's still perjury. Doesn't mean he'd be prosecuted. But it would still be lying under oath. You can't change your testimony...that's the magic of taking a deposition. You lock down a witness...and if they say something different in a proceeding, you pull out the deposition and impeach them with the different testimony. It's kinda fun in court! :)

    But I'm still fuzzy on this proceeding. It's by invitation!!! :D Not subpoena. I mean it's really down to whether one guy did steroids or not. I don't get the compelling state interest for that at all.

    I'd like to read Andy's affidavit, though. Eventually it will find it's way out, I'm sure.

    No way in the world. Clemens is in total control of this. Hardin's job is to advise him of the risks and consequences of each option. It has nothing to do with Hardin saving face. It's all about Clemens saving face, losing face and possibly going to prison.

    I know, but Hardin is also in it for himself....he loves the attention and the billable hours.....as much as the next guy.

    I am sure he is telling Clemens the risks, hopefully Roger will be smart enough to listen now.

    I'm pretty sure Hardin isn't going to the poor house once this thing is over. As much as he loves the attention, I'm guessing he wouldn't want a client lying under oath either.
