True. But she also said that money was NEVER her motivation. Upon further investigation, she was exposed to be untrustworthy and the DA refused to pursue the case as a criminal one. Now she is trying to get money in the civil court? Rumour have it that she was the one chasing Hayes - that she was bragging to many that Hayes was his boyfriend despite the fact that she was married. Anyway, since the DA refused to pursue the case the only thing I feels lil Hayes is guilty of is fornication [with a married woman to boot]. Anyway the burden of proof is not that high in a civil court so she has a big chance of winning if a judge agrees to take on the case. P.S. The woman though is a cancer survivor - she will get all of sympathy from that. If I am Hayes, I find a way to settle out of court especially since her demand is not outrageous in order to avoid the unnecessary...
Woah! Wait a minute... She is suing him for the pain of the trial she brought forward? So if I sue someone and the case flops, I can then sue them again for the ""sustained pain and suffering, embarrassment, and damage to reputation" caused by the aforementioned flop? Someone who is a lawyer please tell me this is going to get laughed out of the courtroom.
http://www.chron.com/disp/story.mpl/sports/bk/bkn/3809222.html Prosecutors had decided not to pursue rape case Copyright 2006 Houston Chronicle LEXINGTON, KY. - A woman whose claim that she was raped last year wasn't pursued by prosecutors in Kentucky has sued Rockets forward Chuck Hayes for damages. A suspect was not publicly named. However, an agent for Hayes, who played at the University of Kentucky, confirmed at the time that Hayes had been notified of the investigation. The woman is asking for $75,000 and unspecified punitive damages for "pain and suffering, embarrassment and damage to reputation," according to the lawsuit filed in U.S. District Court in Lexington. Fayette County Commonwealth's Attorney Ray Larson announced in November he would not pursue charges because he had "serious doubts about the complainant's credibility and great concern about the lack of corroboration of her account." Smithers claims she was drugged and raped April 20, 2005, at Wildcat Lodge, which is where some Kentucky men's basketball players live. Assistant Police Chief Ken Hall has said Hayes, a Rockets rookie, told police he and the woman had consensual sex. Bill Duffy, agent for Hayes, declined to comment when contacted by phone in California
Alot of women who were really raped are to scared to come foward, and the ones who want something in return never were raped.
I think that's what she's counting on. $75,000 is not a lot of money for an NBA player. One thing that I'm wondering is if you or your wife or your daughter was really drugged and raped, would you settle it for $75,000?
We dont know. Let't not judge too quickly. On the other hand, I agree with DD, there gotta be a purnishment for fake rape victims, since currently the gain is so much and virtually nothing to lose.
I love how some people here know exactly what happened based on a couple newspaper articles. Awesome.
You are right - I will not settle for that. Especially if I feel even more wronged by the DA's office for not pursuing my case and taking my offender to court/trial - I will want to get my pound of flesh in the civil trial (a gigantic pound of flesh).
