    The difference is damages. Erin Andrews was suing for emotional distress not damage to her career. Given that part of her career is being seen as a sex symbol, a sex tape, or a tape of her taking her clothes off wouldn't hurt that image....in fact it could actually enhance it.

    With Hogan, the tape's release caused him to be personally damaged. Him saying the racist BS pretty much permanently ended his career and potentially cost him millions of dollars on top of any emotional distress it could have caused.
