    This is mild, at least he didn't slash any throats this summer.

    Seriously though, he and any other athlete that drinks and drives is an idiot. When you have money you are an easy target for lawsuits. Let's say he gets into a fender bender and is at .081, he has just possibly given up lottttts of money by way of suit. Stupid, just stupid.

    This should be an interesting year.

    I don’t have the time or energy to it would take to poke all the holes in this report. But ill point out a couple just for fun. 1. I love how they use the word scientific over and over when talking about their research but NEVER show the details of how they came to these "scientific" conclusions. If these results are really based on "scientific study" shouldn’t they show the specifics of how they came to theses conclusions. 2. MADD (the organization that wants zero tolerance) is the sponsor of this study.

    Yeah - why bother doing that when you can just make comments not supported by any facts? I mean, just make broad assertions, don't back them up with any facts and then try to disperage the results of other people's work without any research of your own - that's much easier.

    Sure, MADD and NHTSA are biased, but you've clearly shown no bias at all...

    You want to play? Ill play! Show me where I "made broad assertions". Every thing I said is backed by facts and that is more than they can say about their report. Show me how I was biased in anything I said. You think you know more than me about this subject lets see. I think you are just trying to make youreself feel better by saying what you think is politically correct. Sad!

    ^This is truly baffling. He's been in Houston 3 years now and is still with a Canadian driver's license? Why would he also list his address as Toronto? I'm sure he still has a home there but I don't think he spends his summers in Canada.

    "Donna Hawkins, an assistant Harris County district attorney, said Alston faces up to six months in jail and a $2,000 fine if convicted of driving while intoxicated"
    ^So if he's convicted there's no way he can avoid the 6 months in jail? What would it take to convict him? I'm confused now since I've read posts saying he can't go to jail because it's his first offense, so is the CHRON lying?

    How can you not miss Rafer on Washington..

    Didn't Rafer get a DUI last year too and then went on to apologize?? How many apologizes does he need to get it right?

    Responsible adults should be able to avoid getting behind the wheel while intoxicated, no matter how famous they are or how much money they make.

    Say no to "drinking drive"!

    It's up to 6 months in jail. The punishment range on a first DWI is 3 days- 6 months in jail, but he is also eligbile for probation. So when people are saying he won't go to jail on a first offense, its because they assume he will either get probation or a very small amount of jail time and maybe a fine if he's convicted.

    It's DWI, other states call it DUI and the media always seems to use the terms interchangeably. Texas does have a DUI, but its a Class C (like a traffic ticket) offense and it is only for people under the age of 21 driving with any detectable amount of alcohol in their system. If you're under 21 and you're over .08 or have lost the normal use of your mental or physical faculties you'll still be charged with DWI; DUI is a lesser crime.

    Rockets guard Rafer Alston will go to trail on Oct. 22 over a charge of driving while intoxicated, according to Houston Chronicle.

    "We just wanted to get it done soon," attorney Rusty Hardin said, adding that he expects the trial to take about two days.

    Alston was charged on Aug. 7 after being pulled over by police in Houston.

    If convicted, Alston faces up to six months in jail and a $2,000 fine.

    Six months? I know there are more important things to take care of in this matter but if he gets 3 months that could hurt the Rockets. This is his 2nd offence isn't it? I guess that’s 1 reason they want this to go to trial soon.

    This is his 1st DWI right?
    I am not sure which state he got DWI from but....

    According to New York state law:

    "Driving While Impaired by Alcohol, VTL Section 1192.1:
    Considered a non-criminal "traffic infraction" which does not leave the driver with a criminal record, this is the least serious DWI / DUI offence. The penalties can range from a minimum fine of $300.00 and a maximum fine of $500.00 to up to 15 days in jail or both. However, if the driver has already been convicted of one prior DWI / DUI offense in New York, the penalty is increased to a minimum fine of $500.00 and a maximum fine of $750.00 or 30 days in jail or both. If the driver has been convicted of two or more DWI offenses in New York, then the classification of this DWI offense is changed to a misdemeanor (which does give the driver a criminal record) with a minimum fine of $750.00 and maximum of $1,500.00, plus up to 180 days in jail or both."

    So as long as it is his 1st offense, he will spend less than 15 days in jail.

    If OJ and MJ can get off, Alston can too. Cmon. He'll get the celebrity treatment and get like 3 days probation or some ****.

    That would be true if he committed this offense in New York, but since it happened in Houston, you use the law of the state it happened in. It's a punishment range of up to 6 months in the county jail...not 15 days. However, even if he is convicted he is eligible for probation and is fairly likley to get it from the judge or jury.

    Bad joke of the day: If Rusty Hardin is a true Rockets fan, he will turn on Rafer and make sure they lock him up for 6 months. Afterwards, he'd say "I can't take another season of 39% shooting."
