    I don't get it, an Aston Martin doesn't have a auto headlight sensor, or he had it disabled at the time ?!?!

    He must have really been having a hard time driving without his lights - uh - I see the defense's case now ' His switch was malfunctioning, and he couldn't see to drive'.

    Rusty Hardin doing a DWI case is like Ron Artest playing in Nike Pro City in NYC.

    I think the Rockets will punish Rafer with some sort of short suspension (1 or 2 games would be the guess), if for no reason other than to make a point to Ron Artest that they are going to dish out appropriate reaction to bad acts even if it involves a player liked by his coaches and teammates.

    I hope he doesn't get jail time. But if he was that drunk and belligrent maybe he deserves it.

    I think the Rockets need to come down hard. Not cut him, but certainly give him at least a 10 game suspension.

    First time DWI offenders don't get jail time. Being belligerent is not smart (but normally people who are intoxicated obviously aren't thinking correctly) but it's not even a crimal offense.

    At least a 10 game suspension? Are you serious. That's ridiculous. I'll be a little surpised if he gets 2 games let alone "at least 10." Man, Roger Goodell wouldn't even give him that type of suspension.

    I lived in austin for 5 yrs or so and would go to Cocktails for happy hr from 4-8 and .50 drinks, The Backroom for .25 drinks and this counrty and western bar ( even though I'm black) for .25 drinks and when I got trashed, I would call a cab. If you have a aston martin, I'm sure u have insurance. It was a bad move made even worse since he had the same problems last year.

    Alcohol impairs the mind. If he had to many drinks and his judgment was affected can you really blame Refer for driving home? Whomever served him is the one responsible for his safety once he gets to the intoxicated stage. This is why bartenders get TABC certified. The bar he left should of strongly recommended that he take a taxi. If he refused then they should have called the police to warn them an intoxicated person was about to be on the road and then they should of documented the incident.

    Oh and now with the alcohol legal limit at .08 I would be willing to bet that more than half of the people here who say they would of takin a cab have in fact driven over the legal limit.

    Let me get this straight. I choose to drink and drive, yet the bartender is legally responsible for my actions? Is that actually true? Just curious, because I bet bunches of DWI offenders would get off that way.

    Anyways, put me in the half that's never, ever have driven under the influence. It's just not responsible.

    First time DUI is not a jailable offense....at most defurred adjudication.
