That's a good question. Probably because most divorce attorneys make a living filling out a form letter. I simply can't imagine a worse way to make a living - but the system makes the industry lucrative. And honestly you do not have to be a very good attorney to practice that form of law and still make a comfortable living. I know, I've seen it. I can only speak from my personal experience in respect to the system. In our case we spent thousands to have an attorney fill in the blanks on the form letter. Things grew less amicable as she violated court orders and we eventually went to mediation where it was determined I had been getting the shaft (she had been double charging for insurance for two kids by charging me the full amount and the other father the full amount). Numerous other issues were raised about her violations of court orders. Mediation took care of all issues, all in my favor. Simply because I asked my attorney what was fair under the law and for that I asked. Time goes on and there are the same violations of the court order. I spent $5,000 bucks for nothing. The only option was to take her to court, spending thousands more, to have the court enforce the court order. Or live with it. Meanwhile the system decides that the new amount I should be paying should be set up as an entirely new account. A few months go by and I start receiving letters telling me I owe thousands of dollars in back child support even though I am over a thousand in the positive. They are billing me for the original court order and they are billing me for the court order that resulted from the mediation. The letters from the State to my house proclaim that lack of payment will result in jail time and are accompanied by letters to my employer telling them to withdraw a greater amount. While it was fairly easy to straighten out the mess and prove what was what, it was a shame to have to bring my employer into the loop due to the State's error; spending the hours of time when there are precious few hours as is. Bottom line in my experience: I violate the court order in respect to payment and I get threatened with jail or have my wages garnished. She violates numerous court orders and I have the option to pay thousands to obtain a proclamation from the court telling her to comply. As at this point court and lawyer paper ping-pong is counterproductive; instead I take the mindset of wishing her the best and dealing with it in the interim.
I would really like to substantively reply to this, but because your situation is specific, any attempt to reply could be construed as legal advice. Therefore, it is in the best interest of all involved to not substantively reply and to express my disappointment in your experience in the legal system and to wish you all the best going forward.
Your name you go is kinda weird considering you really seem like a class act. I just read this thread threw and i heard your story. I am very happy you got your son and hope your daughter will decide to live with yall. You must be a strong person because i'd seriously go crazy if that happened to me.
Why is a name indicating he is a good fisherman (at least when it comes to baiting hooks) kind of weird?
People are stupid and facebook proves it. I did not want to make a new thread for this - but it's amusing reading.
