    I am curious as to this as well. Also, did you fail a field sobriety test?

    Also, if you ever get pulled over, be sure to mention to the officer that you pay his salary. And ask for his badge number. Always ask for his badge number. They LOVE that.

    No way he would have. 4 beers in 7 hours? That's like having 2 at noon with lunch and 2 with dinner at 7pm. Absolutely no way would he have been over the limit.

    if you weigh 100 lbs and drink 4 beers in 7 hours, it is only .04, DWI is .08. I assume he weighed a normal human weight, so it should be no question.

    However, like everyone else, why would he have expected you of drinking if the facts you gave us are correct?

    It really is stupid. Big government and the po-po trying to prevent good ol boys like Fatty from killing people with their cars because their too selfish and irresponsible to limit their drinking. Damn them and damn MADD. Bunch of hippie losers! Just because people die when you drink and drive and it usually isn't you doesn't mean those crooked coppers should try and stop you! Would do they think they are!

    Don't worry Fatty. I've got your back. I used to sideline as an alcoholic too. :rolleyes:

    According to my attorney brother in law, he can get the case dismissed every time if the person refuses to test. And if they get a warrant for a test, the blood test is best. Its the most accurate, and its retestable since they keep a portion of the sample until the case is finished. In most jurisdictions, it takes a pretty good amount of time to get a warrant to draw blood, so your BAC will usually drop significantly in that amount of time.

    Other things to consider. Field sobriety tests are a joke that are used to arrest you. Most people will fail when completely sober. Its pretty much only used to give "probable cause" to arrest.

    So the moral of the story: If you blow, you take all the risk of a conviction, but you *might* not even get arrested. If you don't blow, you'll be arrested, but you almost certainly won't be convicted.

    His advice, never ever test if you've had ANYTHING to drink.

    of course, if you have 1 drink 7 hours ago and 3 more in the last 30 minutes, that may make a difference...

    JBII, did you do a taped interview at the station?

    A pretty terrible mistake to make after 2 am.

    great advice.. plus if the cops were pretty sure he was drunk and over the limit, they should have gotten a warrant for blood test but they didn't..

    lights off was the reason they stopped you

    lights off and driving at 2AM was the reason they assumed you were driniking

    well, I did the HORIZONTAL GAZE NYSTAGMUS TEST, and the sidewalk test where you walk in a straight line. In retrospect, I shouldn't have even done that.

    and I thought I passed them. I wasn't stumbling at all.

    If you find yourself in this situation, never do field sobriety when it's 50 degrees outside and you have nothing but a shirt on.

    I have a good atty, and the odds of me getting this dismissed are in my favor.

    I'd normally say, I'll be better prepared for next time, but there won't be a next time.

    Even if I win, this is a loss.

    So, using this example, even when the person is certain they are not over the limit (with 4 drinks in 7 hours), they should refuse a blood test and spend thousands in lawyer fees?

    I understand not testing if you think you might be hovering around the limit, but if you are certain then I just don't see the need for going through the hassle and costs. Just do the blood test.

    You will most likely get off if you have a clean record. Just be prepared to shell out the cash. It's a fleecing. The more money you make, the more you will pay the courts. Then, to get the arrest expunged, you pay a whole lot more.

    They would, if they were tested. At this point, DUI is a predatory revenue making strategy at your expense. Even after one beer in 2 hours, there is still a chance you could be booked.

    A-ha... no headlights at 2AM... AND nothing but a shirt on. Next time remember the pants. 19 hours in the lock-up with no pants can't be a good thing. :eek:

    I believe the cops either get a warrant to get a blood test or not.. if they don't get it, you can refuse without no penalty. if they get a warrant, you have to choice but to let them draw your blood.
