rookie mistake I guess. I didn't even know the blood test was part of the process until I was booked. So I automatically said no. and I was always told to never take the breath test, so I didn't.
what were you pulled over for? If you refused all test you should be able to get it dismissed. But these things are a pain, expect to go to court a few times and spend a couple thousand.
What happens if you refuse the blood test? Is there anyway to refuse the breathalyzer and opt for the field sobriety test instead or are you taken automatically to jail for refusing the breathalyzer?
You did good -> NEVER blow since the breathalyzer is too inaccurate. I would've done the blood test personally, but that's a moot point now. First step: get a good DWI attorney.

you would rather have them draw your blood than take a breathalyzer? i believe they first ask if they can give you a breathalyzer test and if you say no then they ask if they can draw blood...if you refuse again then you goes to jail. in austin our new police chief has instituted 'no refusal' weekends during holidays - as in you cannot refuse the blood draw. threadstarter: were you actually concerned that you might not pass if you took it or was it more that you just dont trust the police? if i knew i would pass i would take it, but if i wasnt sure i would refuse and just do the '24 nap' as bill hicks called jail. i remember rudy t had to spend the night in jail after refusing the breathalyzer - take solace in the fact that you are in good company!

It's good that he didn't take the breathalyzer, right? I mean even if a little alcohol was detected, he could have stilll received a DUI. Isn't your license automatically suspended if you refuse the blood test?
I wouldn't blow even if I had one drink, unless it was hours beforehand. The calibrations have been known to be changed on site, which is why low readings have been re-registered at time of arrest. If you ever read over on a breathalyzer, find a law firm willing to test their readings. The whole thing is so stupid. Cops literally sit outside bars like vultures now. I still recall a decade ago, a cop would be rational about it. Now they see a nice profit. Just put some improvement in Public transportation. Unfortunately, somebody figured out MADD's outrage could equal big money, so they went with it.
