Anyone high at the office is automatically fired, no questions asked. He smelled like it, but during our talk he seemed ok. I do not want to instigate a pee in the cup culture. But, he has been warned, and the rest of the office knows it too. Hell, I had 2 Red Stripe beers at work yesterday afternoon, we aren't a prissy office, just one that needs people to be within the law. DD

Texas is a work at will state, but there are a few federal laws that can come into play that protect certain groups from discrimination such as ADA protects disabled Americans. I would consider getting high (or drunk) at or before work to be an error in judgement. What other risks has he taken? Is he as safe with my product as he is with his job? If he had exemplary service beforehand, I would weigh the risks and rewards. If I could replace him with someone of similar quality who hasn't shown poor judgement, he would be gone.
