    The company policy is "no drugs" but I tend to not enforce it when it pertains to being away from the office.

    However, you have a point about the lawsuit, but he is a contractor and I can terminate him for whatever reason I see fit.

    I like Fatty's suggestion, I know he is cowering down in his office right now, scared stiff.

    But probably not too scared, more of a "really relaxing" scared.

    :)

    Being high or drunk at work is not a good way to get career advancement.

    I think you should just look the other way. No sense getting rid of someone who has a firm understanding of your target market.

    You're correct. You can fire people in Texas for doing anything, up to and including being drunk and passed out in front of your computer with your pants around your ankles.

    Do what you really feel you want to do, don't try and "be kind" if you feel you are permanently incapable of trusting the guy. If that's the case you'll just end up hounding the guy for 6 months and firing him for some trivial issue.

    Personally, I would think this kind of behavior would be more common among artist types and might be correctable, but you probably deal with quite a few more than I.

    ...of course, this is all a moot point if he's a Spurs fan...If he's a Spurs fan, you should definitely fire him, then institute immediate background checks on future employees...

    DaDakota, I think FFB's previous advice was the best bet, especially since you didn't actually see him doing it. I also agree with Harrisment...it's probably not a negative affect on his work. :)

    shake him down and donate what you find to the Toyota Center to have it pumped into the airconditioning system.

    that will get the crowd going.

    You want your employees to do their work well and to be responsible. This is what makes good busineses: employees doing their work well, management making the right decisions.

    Someone who
    a) is stoned at work and
    b) has the nerve to show up to work stoned

    is not at all good for the company.

    Can him now, set an example and let your employees understand that if they want to get high at home without affecting their work, fine. If they want to show up to work stoned, then they will get their asses fired.
