I received a medical release of information from the woman's insurance company. Why do they need to have this information?
They want info so they don't have to pay so much if you sue for medical bills. You have no reason to sign that at all. Throw it away,.
You are giving him very bad advice. Due to HIPPA laws, insurance companies can't request medical invoices, history, records, etc. without the patient's consent (i.e. medical release of information). Having him sign a medical release of information is VERY standard in an injury claim. The burden of proof is on the injured and the insurance company has every right to investigate the claim. He has every reason to sign it and if he doesn't, the insurance company is not going to pay any medical claim. In fact, if he refuses to sign it, then the insurance company may suspect fraud, which is only going to complicate any settlement for him.
he is not asking for injury money. The insurance company has no need with his medical records. My advice was spot on.
damn man sucks for you, its either the woman cannot drive, too old to see the stop sign, eyes hurt, or its a young woman that thinks shes too cool to stop for a stop sign.....i hate people like that, if you dont really want to stop at least brake a little and make sure theres no cars...damn it i feel ya
So, I have some questions. The insurance company that is handling my claims wants to settle for $9500. That money is to be used to pay my medical bills as well so afterward I would come out with about $4000. My question is what do I do about insurance bils that I have already paid and/or paid my deductible on? Example I: One of my bills totaled $436. The medical facility filed my procedure with my health insurance so now my bill is $174 and that's how much I am responsible for. The auto insurance company is paying me the full $436 as part of my settlement. Example II: I visited my family doctor as told to by the ER physician. They charged me my co-pay and billed my insurance. The total there is $85. So, how do I handle this? I mean giving the medical facilities the money doesn't seem right since they have already been paid once by my insurance and are just waiting for me to pay my part. It doesn't seem right to keep it either since the other insurance company is paying me this to pay the medical bills. How does this work, I'm not trying to get caught up like I am trying to commit insurance fraud or something.
To me it seems like they are just giving you a settlement and you can spend it as you like. The fact that you had health insurance to cover the medical expenses is a separate issue from the fact you are receiving a settlement with the auto insurance company.
