Churches should continue to have the right to marry whomever they want...and coercion by government would completely undermine religious freedoms...

This is great. Scalia is right, there is no law anymore. Words mean nothing. It's just a pretense for judges to impose policy outcomes they like.

I'm assuming you haven't read through Alito and Scalia yet.

I don't know what happened to Alito but the man has a DEEP fear of every and any ramification of same-sex marriage.

Maybe Scalia should resign from the court in disgusted protest...

    Take Clarence with him.

Not Alito, but what I read in Scalia doesn't attack gay marriage. He even seemed to suggest that he didn't care about it at all, rather was furious with the court's policy making efforts.

The textualists have suffered a mighty defeat this week because it's not just words that matter but the context that infuses them.

He must have missed the very pointed legal reasoning of not having to undo another Bowers desicion, the court's role in fundamental rights, and debunking the unlogic of "enabling same-sex marriage harms opposite-sex marriage."

Seriously, if there had EVER been a trainwreck of oral arguments, that one argument had to take the cake.

we're being socially transformed by the dictats of unelected judges, rather than the will of the people

That's a cop out. He does care. His dissent in Windsor more accurately reflects his thoughts. I think Roberts generally understands the positive impact on the lives of gays and lesbians that this decision has even if he disagrees.

Alito is just bitter. Then again he saw this coming. He said as much in his dissent in Windsor.

I best the Majority of Americans were for segregation 100 years ago.
