Breaking: same-sex marriage now legal in all 50 states.

I'm wondering if Roberts' dissent has to do with ameliorating Scalia. After voting against Scalia on two major decisions this session he knew that the same sex marriage would be upheld since Kennedy was for it so he voted against it to make peace with Scalia.

If that were the case, Roberts would be a terrible judge. There's no reason you should be voting for things - and writing long legal dissents - to maintain a friendship with another judge. Besides which, don't Ginsberg and Scalia hang out all the time outside of the court? I'm pretty sure none of these people take anything personally.

 

The Supreme Court is not the Pope nor the board of directors for the Southern Baptist Convention. It's not trying to tell churches what to do.

The Christian faith isn't being threatened at all by this ruling unless you somehow think a joint tax return is an exclusive providence of God....

 

I'm not an expert on this but my understanding from reading other court watchers and history of the USSC is that there is a lot of trading and dealing going on behind the scenes. While Scalia probably isn't hurt personally it gives more force to his dissent if it is a 5-4 decision versus a 6-3.

 

I could see there being trading and dealing in terms of things like who gets to lead on writing various opinions and things like that, but I'd really hope that no judge is voting differently than what they believe for horse-trading purposes. A 6-3 decision has more moral force than a 5-4 one, and if a judge votes against something they support (or vice-versa), they are doing the country a huge disservice.

Idk. It could just take the issue off the table entirely. I think the smart candidate would say, "The Supreme Court has spoken. It is the law of the land." I don't see a lot of political victories coming from continuing to fight it, and not much chance of victory either.

I don't think they should be compelled because of their freedom of religion. Probably, if that's their position, people in biracial relationships probably don't want to associate with them anyway. And, there's plenty of other churches that will accommodate.

It is just a matter of time. We have already seen lawsuits against photographer who refused to take pictures of a same sex marriage and a baker who refused to make a cake based on religious beliefs.

 

No, it's not. The bakery is not a church. The photographer's studio also isn't a church.

And those cases will be dealt with in accordance with the law, just like a black couple can sue a photographer or baker for refusing services based on race.

I'm sure there will be cases, but they are unlikely to go anywhere because a church marriage ceremony is a religious ceremony....not the same as baking a cake or taking pictures. I would think those cases would be thrown out pretty quickly.

They were always gay and even living together. This affects population growth by exactly 0%.
