I fully expect the DOJ to appeal delay decisions to the 11th court, or even the Supreme Court because of the open threats to pardon himself, and escape justice. I think the higher courts will side heavily with the DOJ because everyone, even SCOTUS, will want to avoid a Constitutional crisis where Trump wins the election, and has a court date scheduled two weeks after the election. I do fully expect Judge Cannon to approve of every single request that team Trump makes. I would just assume that's the case at every step. It's the 11th court of appeals that'll basically be in charge of this case in the end I'm sure. Even if Trump is convicted, I would still then expect Judge Loose Cannon to try to get him off with probation, and then the DOJ to appeal that.
I'm still thinking even if Trump is found guilty he won't actually see prison time. I think the spectacle, also the practical matters of jailing a former President will give any judge pause. I have a hard time seeing Biden or Garland wanting to deal with seeing Trump behind bars. If Trump is found guilty I think he will get probation, heavy fines and at most house arrest.
The venue heavily favors Trump and I think Jack Smith knew that. Because a lot of the events of the crime occurred at Mar-A-Lago he had to do the prosecution in FL but I also think he feels trying it in FL reduces political blowback. He could try it in NJ, and that's still a possibility.
Yet Trump the Traitor thinks Hunter should have received the death sentence. He wants nothing more than to take power again, insert his own police and jury, and take revenge. That's all he cares about now. Probation isn't an appropriate penalty for a seditionist traitor like the orange man.
...I agree, sweetie. But again: deserves got nothin' to do with it. The question, ultimately, will be this: Can (what's left of) this nation stomach a former president of the United States being jailed like the common orange criminal he always was, and thereby reinforcing all of these aggrieved numbskulls' beliefs that their country is being taken away from them? What's better for all of us----making the Donald a pariah or a martyr?
What's better is that the scales of justice don't favor the people with money and power, regardless of who they are. If a President can commit felonies, sedition, or treasonous acts without punishment, then our future leaders will be invisible to commit any crimes they please. That would give any future leaders of this country the green light to act like Kim Jong Un or Putin. Nobody is making Trump a pariah. He is responsible for his own actions. He does what he wants, without an ounce of remorse.
...my only point is that a pariah is not so readily embraced and championed (by anybody) as often as a martyr is. Personally, I'm fairly confident little to nothing in the way of violence would ensue, if the Donald's shackled little hands had to go to the big house. One thing we've learned from all of these insurrectionists and secessionists is that, all things being equal, their bark is a lot worse than their bite. They do their forbears a serious disservice. They had the gumption to actually secede and take their chances. But I've also learned to never underestimate the power of determined, committed idiocy...
Probation isn’t appropriate given there are people doing long jail sentences for similar crimes but in addition to political there are practical issues with jailing a former President. A former president still gets secret service protection. I doubt any existing US prison is equipped to deal with the requirements of jailing a former president.
Some ex President can commit felonies left and right after being voted out and maybe not go to prison because of practical issues? The simple solution is to change the laws, or adapt to the situation. When a military member gets a dishonorable discharge they lose privileges, so the same should be said of the ex Commander in Chief. Trump should just be thrown in with other felons if convicted, and lose all privileges. I know the white collar politicians will always protect themselves from the same treatment of those they call "thugs" though. Even if they let him keep Secret Service after a felony conviction, prison accomodations should not be a reason to let a felon walk free. Put that sociopath in a cell and let Secret Service stand guard outside it if they must. The sad part is that some felon would be treated better than other felons with equal or lesser crimes, because the law allows it. A felon is a felon. He won't get convicted in Florida though. Too many MAGAs. I doubt a MAGA juror would ever convict Trump, even if the evidence presented was undisputable. Cult loyalty is scary. Trump has brainwashed them with so many lies that they refuse to accept truth. I hope it's different for his Jan 6th trial. It's disgusting really. You have guys like Trump calling for the death penalty, on others dating way back, when he assumes they were guilty because of bias or prejudice, yet bragging how he could kill someone and get away with it. Now he knows he can subtly order a kill in the future by demonizing his hated targets to his radical supporters, and saying they should be hung, get the death penalty, or simply posting their address or location on social media. I have no doubt if he walked free and got elected again that he would shred our democratic system to bits. He wants supreme power. He wants to profit off his Presidency and live like a King down at all his resorts, while wining and dining with his rich friends and other corrupt foreign leaders. I can see him throwing in the National Guard to beat down protesters any time he feels like it, making his own SS police state, replacing all heads of FBI, CIA, and our DOJ with loyalists, and making unlimited term limits to stay in power. It's actually possible, when your party will back you, even after being a seditionist traitor to our country. The scary part is what could happen when a narcissistic sociopath with a hunger for wealth and attention has unlimited power.
I hear you and in an ideal world Trump would be found guilty and doing hard time. We don’t live in an ideal world. I do think that Trump will be found guilty even in FL. Jack smith is smart and he has some of the best legal minds working for him. The 11th district has shown they won’t save Trump from shenanigans that Judge Cannon. At this point I’ll settle for Trump being found guilty losing the next election and for the remainder of his life stewing in bitterness in Mar a Lago while history records him as the worst President this country ever had
This is what sickens me about our justice system. It's actually possible, when your party will back you, even after being a seditionist traitor to our country. I have less faith in a few MAGA jurors than you. It's too much of a cult, and they see him as some Superhero and our government as the enemy. Personally, I know it's just one of many trials he will face, and I still hope he doesn't walk free, especially if convicted of felonies. Felons in prison can't even vote, so if he's sentenced for felonies and put behind bars I don't see how he can even run for President.
