    Prosecutors in the special counsel's office have presented compelling preliminary evidence that former President Donald Trump knowingly and deliberately misled his own attorneys about his retention of classified materials after leaving office, a former top federal judge wrote Friday in a sealed filing, according to sources who described its contents to ABC News.

    U.S. Judge Beryl Howell, who on Friday stepped down as the D.C. district court's chief judge, wrote last week that prosecutors in special counsel Jack Smith's office had made a "prima facie showing that the former president had committed criminal violations," according to the sources, and that attorney-client privileges invoked by two of his lawyers could therefore be pierced.

    In reaching the so-called prima facie standard to pierce Corcoran's privilege, Howell agreed prosecutors made a sufficient showing that on its face would appear to show Trump committed crimes. The judge made it clear that prosecutors would still need to meet a higher standard of evidence in order to seek charges against Trump, and more still to prove his guilt beyond a reasonable doubt.

    "It is a lower hurdle, but it is an indication that the government had presented some evidence and allegation that they had evidence that met the elements of a crime," Brandon Van Grack, a former top national security official in the Justice Department who is now in private practice, told ABC News.

    legal services were used in furtherance of a crime, so attorney-client privilege didn’t apply,​

    A three-judge panel – Judges Nina Pillard, Michelle Childs and Florence Pan – at the appeals court now is positioned to decide whether to put on hold a lower-court ruling that Corcoran (Trump;s attorney)
    must provide additional testimony to the grand jury about his conversations with Trump. Trump’s team has argued those conversations are covered by attorney-client privilege and should be shielded in the investigation.

    An appeals court in Washington, D.C., has ruled against an attorney for former President Donald Trump, ordering him to comply with a federal grand jury subpoena to testify and provide information about
    his communications with Trump in its investigation into possible mishandling of documents with classified markings found at his Mar-a-Lago residence.

    in view of this development, it'd be far-fetched to speculate that Special Counsel Jack Smith may be the first to indict orange hair trust-fund baby.

    Last July, Trump's attorney, evan concoran, wrote a letter to the FBI assuring them that all classufued documents have been returned. the letter was signed by another Trunp lawyer, Christina Robb.

    about a month later, FBI found more classified documents in Mar A Lago, including some on Trump's desk.

    speculation abound that Jack Smith may have produced evidence in court that Trump may have misled Concoran, leading him to write that letter​

    Wow....just WOW. I really need trump to remain out of jail for a while so he can muck up the gop chances of getting behind anyone else other then trump................what's a little espionage and treason, I am sure he has learned his lesson.....no really, my friend Susan Collins told me the same thing. He cant possibly do anything worse right????

    maybe that's why i saw a video of him yesterday where he looked pale and sick. (perhaps he is just sick) hmmm he could just be actually worried about an investigation that has clear merit.
