I'm sure that will be a good legal argument for the Jan. 6th defendants.

    200 of them got arrested.

will trumpers say they are being held in gulags? are they hostages? should the president pardon them? are they patriots?

It isn't a consistency argument because Jan. 6th wasn't consistent with these protests.

That being said Palestinian support protestors were arrested so that is consistent.

Is the FBI going on a nationwide manhunt for everyone they can identify as being present, or is it just the people they managed to grab at the scene?

The people at this protest weren't a threat to our democracy. Some of those at J6 were. If the FBI has credible information about government planning with these protestors, then they should have a manhunt to investigate that possibility.

Since I have seen no credible evidence of potential conspiratorial involvement, I would certainly hope not. J6 absolutely had that and they should have looked into following that evidence.

Apparently even actually assaulting the officers yourself is not as bad if you have the right politics as wandering around the Capitol and taking selfies.

Couldn't it be that there isn't enough evidence to pursue a prosecution in those cases?

What were the reasons for dropping the charges? Could it have been because they were minors?

It is still illegal for minors to assault police officers.

Yes but you as a prosecutor are probably aware that prosecutors and judges will give more leeway to minors.

So if the argument is somehow these protesters are getting special treatment how would that apply to other cases where minors or others had charges dismissed?

Anyway as not being a judge or a prosecutor in DC my personal opinion would be still to prosecute these rioters. Whatever think of their cause doesn’t change they and I’m not going to defend them and most definitely not call any prosecuted “hostages”.

Maybe that is how they do things in DC. In my jurisdiction we don't typically drop charges against minors for attacking police officers, especially when the evidence is recorded.
It applies very directly to cases like the BLM riots where thousands of charges were dismissed. It's almost like there is a very clear difference in the treatment of rioters depending on which cause they support.

Judge sets Aug. 16 hearing in Trump’s federal election interference case

Judge Chutkan will be responsible for applying the Supreme Court's decision to the allegations in Trump's criminal case, including whether Trump's actions were "official acts" or private conduct that can be prosecuted.

Trump last year pleaded not guilty to charges of undertaking a "criminal scheme" to overturn the results of the 2020 election by enlisting a slate of so-called "fake electors," using the Justice Department to conduct "sham election crime investigations," trying to enlist the vice president to "alter the election results," and promoting false claims of a stolen election as the Jan. 6 riot raged -- all in an effort to subvert democracy and remain in power.

It's hard not to dispute that those acts were not official acts. They were acts done by a cheat desperate to steal the vote for his own quest to stay in power.

    Because of course he did.

Jan 6 rioter flashes white power sign after receiving 20 year jail sentence

David Dempsey's "brutal" attacks on police officers earned him one of the longest sentences so far handed down to the Trump supporters who sacked the U.S. Capitol on Jan 6, 2021. Sentencing him to 20 years imprisonment, senior D.C. District Judge Royce Lamberth described Dempsey's actions as "exceptionally egregious" and nearly resulting in a "bloodbath" in Congress.

Footage showing him lashing out, throwing projectiles at officers and using other people in the crowd as "scaffolding" was shown in court. Prosecutors cast him as "political violence personified"—a violence they said was directed against officers trying to keep the surging mob out of the building. In one attack, he swung a metal bar at an officer, breaking his helmet.

Before receiving his sentence, Dempsey groveled to the court, speaking of his "profound sense of regret" and apologizing to victims and other officers in attendance. After he learned he would not be getting leniency, however, he flashed the white power "OK" sign in court when bailiffs moved to take him away. Numerous observers at the scene reported the gesture, including NBC News's Ryan J. Reilly.
